It seems that the requirement by USCIS is that of the same job classification and not the same position. So, if I am a SW Engineer and I join elsewhere as Senior SW Engineer (with a higher salary :) that should be fine. Right?

I got an RFE also. It was mailed to the lawyer only. In my case they asked for last 3 yrs W2's and a letter from my employer attesting that I am still employed. I don't know what triggered it, but it happened. Mine is EB3.
I am in the same boat Apr 20 (RD), Apr 25 (ND). No FP. No news. Mine was original labor though. People who filed around Nov '04 even got their physical cards in a little over 6 mos. We are stuck becasue of this retrogression thing.

Finally after almost 3 yrs wait, my lawyer informed me today that my case has been certified. Replied to 3-option letter in Oct. Looks like SFO is moving ahead with the 3-option cases now. Good luck to all.
What a news! Congratulations! Finally they decided to move forward with the 3-option cases. Fantastic. Hopefully some of us in the same situation will receive our approvals soon.
I heard the same. My lawyer also told me that they will probably take as long as they like to resolve the remaining cases since after PERM, they will lose their jobs. The more they drag the old cases, more time they get to be on the job.
