No you Cannot... Labor Certification is Employer's Property not Employees.. What you can do is use that I-140 if it is still valid & file for I-485...
 
Urgent question, please help

My labor is stuck in California.

Just last week, one of the employees in our company left. My company wants to use his labor for me. However, that person has already filed for his I-140 and I-485. Can his labor be used for me? Does it depend on whether or not he completed 6 months after he filed I-485?

Any help is so much appreciated.
 
But I am not working with the company anymore. How can this be possible.

If your X employer is willing to help you & had not already used that I-140, you can always file I-485 as GC is for Future Employment... After 6 months you can decide if you want to join that employer back or use AC21 & continue with current one.

Since both old and new employers are willing to cooperate (infact I joined my client with consent of my employer couple of months ago)... What do you suggest? I140 and 485 at the same time?

I would not waste a day...Go ahead & Apply Concurrent I-140/485.
Are you EB2 ?
 
but what do you put in 140 and 485 current employee or future employee? In 140 you have to mention and 485 also you have to mention the employer?

I140/485 is for "Future Employment" so the company sponsering the application is Future Employer.

Retesting the market

Hello,
I recently got a 3-option letter from DOL. My company decided to retest the market. Normally, how long should this process take? and after we respond, how long does DOL take to certify it?

RD at DOL: Jan21'03
Job requirement BS+0yrs

As of today..
RIR : California SWA = 11 Months, SF DOL = 18 Months
Non RIR : California SWA - Still Stuck on April 2001, SF DOL = 20 Months
 
"We have received notice that the labor certification application was forwarded to the Department of Labor on 06/09/2004. The DOL is currently processing cases received on or before January 2003".

This is what I got from my attorney about the transmittal from SWA to DOL. However, when I tried the AVM at "415-975-4617" it doesn't list my case and lists only some old cases from 2001. How long does it take to be listed?

Now is my RD 06/09/2004 or is it the date at which I get listed( and hence can hear it through AVM)?

Your Attorney has received the "TRANSMITTAL NOTICE" & will also receive "DOL RECEIPT" with your DOL Case#, RD & DOT Code. (There will be difference of few days in between 06/09 & your RD )... It takes about 2 to 6 months before your case shows up on AVM (Mine, it took 6 months ).

I guess you are given 60 days to respond. You should put the ad immediately, wait for responses(resumes), conduct interviews, document your recruitment effort and send it back to DOL. It probably would be best if documentation is done almost near the end of the stipulated period to show DOL that you didn't hurry it up and did a sincere recruitment effort.

A colleague of mine did it this way and got certified within a month of submission of the response to DOL

Were these cases filed from CA?
Are these cases in the SF DOL queue or the Seattle DOL queue?
