MY CASE TRANSFERRRED FROM TSC TO ATL ON 4/21/04

Went to ATL USCIS today

As background, let me explain my situation. My daughter was born last September with a congenital neurological abnormality and is currently on a ventilator. She suffers from partial paralysis and respiratory failure.

The guy at the front desk gave me a funny look when I asked about a humanitarian expedite for an I-485. Since he had just been arguing with the guy ahead of me about mail-in EAD renewals vs. in-person, he just gave me a number to get me out of his hair. :)

Waited for 2 hours, then got called up. The lady I spoke to originally thought I was asking for travel permits (ie. AP), but I indicated that I didn't want to leave the US, I wanted to stay! She said "oh, you want your interview?" The light bulb goes off. "Have your fingerprints been done?" Of course - I didn't mention that they had expired. She still seemed doubtful, and went to talk to a supervisor, and when she returned she said that she couldn't expedite the case.

BUT

She then indicated that if I could document my daughter's condition, there might be something they could do. She gave me the name of the supervisor, and suggested I write to her, which I of course did this afternoon.

I requested an expedite based on my daughter's condition, and submitted my EVL, my most recent paystub (yesterday's) and the latest diagnosis for my daughter. I also suggested that since they had all the evidence they needed, they could waive the interview since INS regs allowed the service to do that in EB cases.

We'll see what happens. :)
 
Atlanta Processing news - Got Interview

Hi Guys,

I got Interview from Atlanta today. My case transfered from Vermont in June 2002 and my receipt date is June 11, 2001. My Interview will be on 15th June. I went personally today to local office to pickup my EAD and requested info about Interview. They said they sent the Interview letter yesterday to my home and I requested for duplicate copy and they gave me the copy.

That is very encouraging. This means that we should not depend on the processing dates. I am just hoping that I hear from them soon. My RD is a month form yours.
Also, are you with the same company who sponsored your green card. If you switched did you fill the ac21 application.
What are the documents they have asked you to get, if any.
Also, after the interview I would ask them if you can apply for citizenship. I am being told now that since we have(assuming you have been here for > 5 yrs) been paying taxes for 5+ years and you are not at fault for the delay, you can request to be eligible for citizenship. With elections coming up they might entertain this question.

Hi Guys,

They just asked general documents like passport, I-94, Original copies of birth certificate/Marriage certificate and current Employmnet letter.

I am not with the same company which filed my green card and I haven't submitted AC21. I am planning to take new company employment letter for my Interview.

After 29+ months of waiting my case has been transferred to Atlanta local office?

Could someone please tell me how long is it taking for processing?

I had the same problem, but on the interview. It appeared that for my wife only they received photocopy of I-643 instead of the original.

No arguments worked. Had to go to physician's office and make them to fill new form. Mailed it back to Baltimore Office. Waiting for response.

These things make you completely crazy. How do you know what they put in the sealed envelope?

Anyway, I wish you good luck. At least there will be less problems at the interview.

PLEASE PLEASE anybody shed some light on my case i am very very depressed.

today a bomb dropped on me when i got USCIS emails, as after 29+ of wait at Vermont the case got transferred to Atlanta on May 20th, 2004.

I have following questions?

1. Any reason why case was transferred?
(i took my FP1 in atlanta and i lived in atlanta 2 years back).

2. when can i expect an interview?

3. how long is it taking for an interview???

The Realcanadian, Waitingforos, tst123, all you guys i have read this forum. I guess initially the confusion was that does Atlanta goes based upon RD date for do they go based upon the transfer date to Atlanta office.

From what i am assuming from this thread is that they go based upon RD date.

Could you guys please let me know answers to above questions?

I am already in 7th year of H-1B. my ead/ap has already expired. I'll be filing for 8th year extension my H-1B.

Why don't you renew your EAD. I have not heard about 8th year H1B extention but yes you can definately renew your EAD, I have done it 4 times so far. Well.......join the team and lets all pray together. tst123 goes for the interview next month, so can definately see light at the end of the tunnel.

Ya.. You could file for 8th YEAR H-1B if your I-485 is pending. that's what the lawyer told me.
