While my transferred case waits approval in Atlanta, I have received consulting/advisory offers from my friends. They want me to allocate up to 20 hr window per week for their clients with 75% billing realization. It’s an attractive opportunity. Questions:

1. I am already full time with 40 hrs commitment. Can I take advisory/consulting engagements in addition? Any views on offsite/onsite work?
2. How do I claim reimbursement for my company? Any tax issues there? BCIS violation?
3. Can I use my EAD, spread my weekly hours and work for multiple employers?
4. Any other view, appreciated?

8CFR274a.12(c)(9) has no limit on hrs worked

GC0001 -

You should be OK in working 20 more hours per week if you like to. CIS regs have no limit defined for hours worked.

Since CIS does not regulate taxation, there should be no tax issue either.

Any more update with regard to ATL processing? Also, would you be able to share a copy of the fax you got from BCIS through Miller indicating that BCIS (ATL) processes transferred cases based on original filing date of I-485 with the appropriate office (TSC for me - RD 5/01 ND 8/01 TD 2/04)? I am exploring the option to file a writ if I do not hear from ATL soon.

I don't have a fax, just an e-mail. Why don't you contact Charles Spry in Zell Miller's office with your situation and see what he tells you? Based on that you can decide what to do.
 
Very Disappointing.....

Processing dates for Atlanta office have been posted on Feb 13 2004 and the dates for AOS is still July 9 2001. Its very discouraging as this date has not moved in couple of months now. My RD is less than 10 dyas away from this date....was hoping to get an interview in Mach....guess will have to wait longer.

Does anybody support the idea of sending a combined letter to the Senator's office....more so will it help doing that? In next coupleof months I will complete 6 years since I applied for Green card(LC-I140-I485) and am losing my patience now .


Any feedback is appreciate.

Can I start an S-corp for billing additional 20 hrs? Is it OK considering the 485 situation I am in (I mean atlanta transfer cases)?

GC0001 - I believe there is no restriction on starting a S-corp for billing the additional 20-hrs. The fact that you are in AOS pending status does not put any restriction on your otherwise routine activities. The only drawback is that, if for some reason AOS is denied, the hassle would be greater. This is a very unlikely possibility. I would go ahead and use the opportunity.

WaitingforAOS - Would you mind checking with Charles Spry about the March interview schedules he was talking about before. I beileve my case is the oldest pending at the ATL office (i.e., if TSC has actually transferred the files yet TD 2/10/04). I still haven't got any notification from the ATL office. I will wait for your feedback from Spry and then will talk to him myself. Please update us.

When was your case transfered and what is your RD. From all the people on htis site...so far my was the oldest case transferred to the ATl office.

I have treied caling charles a couple of times but could not get in touch with him.....didnot want to leave a message. I am goign to try contacting him today. If you wish you can try and talk to him too.....
 
No processing....

I just spoke with Charles and it seems that the Atlanta office has not processed any 485 applications this year and they don't plan on processing any atleast till April if not any latter. So I guess we guys will have to wait for another month if not longer.

You need to talk to your attorney or Rajiv about a writ of mandamus suit. You should get that statement in writing, and then request injunctive relief in the form of:

a) Immedite ajudication of the adjustment petition;
b) Approval of Permanent Resident status retroactive to the I-485 filing date.

Worth a try. Should scare them.
 
Anybody Contacted Chambliss Office?

Has anybody contacted Chambliss office? He chairs the senate judiciary committee and CIS comes directly under this committee's oversight. Spoke with the DC office and was given a runaround trying to locate the appropriate person. Turns out some Leslie Gavin in Macon is the designated contact for such issues.

She has not retunred my call yet. Any other names, suggestions...

Discouraging. They ahve come out with the processing dates for March and still the Atlanta office is stuck at July 9, 2001. I think they have decided not to process any case fro April.....hopefully its not for all of second quarter

My friend's I-485 case was transferred to Atlanta Local Office on March 10, 2004 from TSC Center. His 485 ND is June 18, 2001. He hasn't heard anything from attorney or BCIS yet. He got the information from the online check.

Does TSC send notice when they transfer your case to local office? Any suggestions to my friend since his ND is before the announced local processing date?

Has anyone got interview and then approval at Atlanta Office? It seems Atlanta Office is very slow.

Mr. Rajiv and I will be trying to arrange a personal meeting with Senator Saxby Chambliss either in Washington, DC or Atlanta, GA to discuss about our pending I-485 Litigation against USCIS.
