Update on USCIS website

Hi Rejji27,

About not being able to check your case online, this happened to a friend of mine (EB1/OR) a couple of weeks back.

A day or two later when she tried again, it actually said that her case was approved!!!

So I think that when you cannot access your case online, they may actually be working on it and they take it out of the online case status.

I have heard this happening to someone else on another forum.

Although officially something else is shown - I personally know one guy(EB2) of Aug 20, 2003 being approved. So Patience - officially you may have missed the dates, but unoffically not that much. Keep it up.

It is very promising though I-485 did not move. but as we see once they decide to prioritize certain category it will move ahead very fast. e.g. EB2 move from Jan. 2003 to Aug. 2003 in 2 months!!!
so hopefully one day they decide to prioritze I-485 we will see a big jump in a short time. it seems to me VSC is starting to take our complaint and law suit more seriously.

I'm doing a happy dance as I write this.

This seems to be pretty good news. I'm just worried about what happens once April 30th hits and the new guidelines take effect...

To summarize:

04/22/04 (+14 days):

I-765 (AOS) 01/20/04 (+59 days)
I-140 (EB2 excep. ability) 07/14/03 (+24 days)
I-140 (EB2 excep. ability NIW) 08/09/02 (+14 days)
I-140 (EB3 skilled worker) 08/06/03 (+81 days)
I-485 02/15/02 (+0 days)

So EB3 moved forward 81 days since the last update (14 days ago). This is wishful thinking, but they could theoretically hit 10/23/03 (my ND) by the next update if they keep at the same pace.

A little risky to predict this time. I will put my anticipation of processing dates a little later(I would need some more time).

There maybe a slow down on dates due to new memo on 140 approvals.

For concurrrent filers: 485 approvals of second half(or a little earlier/later) of 2003 will start coming in, for people who have been finger printed. For people who have not been finger printed and 140 not approved, it is a 50-50 chance of being on either side. It will be great if we can have a temporary thread dedicated to people who have been finger-printed(will help in big way to find the trend).

Here is what I anticipate: a month's increase in dates for EB2 and EB3 140. For EAD - it should slow down a bit, but move towards the end of Feb 2004(hopefully Mar 2004).

One thing is definite - 485 approvals which have been delayed for long time, will also start coming in - maybe not(or maybe???) this time - but in near future 485 dates will move with great speed(in next 2 months).

I wish to see everyone happy - wish I could be wrong and dates move in 2004 directly - wishful isn't it? :)
 
ohata memo concurrent filing

to all:

just spoke with top legal experts about this memo. this is their interpreation.....the most important aspect of the letter is the "spirit and intent" of the memo which supercedes the actual wording. do not get caught up in the actual wording. the concept that uscis is trying to implement here is accuracy and efficiency. the applications with an approved 140 but not yet approved 485 will most likely get priority over a case that has not yet received a 140 approval. the "spirit" is to look after the loose ends first, and not to just drop what they've done so far and move on to new cases received after april 30th 2004. that would not satisfy the intent of the memo. (so if you have an approved 140 and are awaiting an approved 485, you are most likely in better shape than those who do not have an approved 140/485 and a notice date in sept oct nov 2003). lets be realistic, if cases received after april 30th 2004 received priority, the customers without the 485 (or without 140/485) would have a "legal" case againt the uscis, and the uscis does not want to come under legal fire during this sensitive immigration time during an election year. bush is doing his best to get the support of the immigrant community. they are going to do things such that they do not come under fire and minimize public outcry! the legal experts explain that uscis will most likely do the following:
1. address cases with approved 140, but not yet approved 485 (and work harder to ensure these get done quickly so as to catch up and have them done according to the 140 approval date (to make them 'almost' concurrently adjudicated. please note that cases filed in mid 2002 still have not yet received 485 approval. accoding to my sources, these need to be addressed before approving any of the 2003 and 2004 applications - its just not logical and would create a lot of 'heartburn' in the system!)
2. address cases that do not yet have either 140 or 485 from 2003 and early 2004. adjudicate them concurrently according to the 140 date (if the 'loose ends' dont take too long).
3. address cases filed after april 30th 2004 and adjudicate them concurrently.
this would satisfy the intent of the legislation and more specifically the ohata memo. if we think about it for a second or two, the uscis recognizes there are problems, bottlenecks, etc.....and what they are trying to do is make the systme better, NOT worse!!

Thanks for posting a lot of "information" and "interpretation". If the I-485 adjudication indeed comes through with the I-140, well, I'll probably go try my luck at a las vegas casino next!

USCIS Answer: If there has been no adjudicative action regarding the I-140, our recent memo would also apply to concurrently filed I-140/I-485 cases that are in our adjudication pipeline. If we have already adjudicated the I-140, our memo would not apply.

Question: Do you plan to have a single PTR [Processing Time Report] date for I-140s filed as stand-alone and for (same classification) I-140s filed concurrently with I-485s? (In other words, will an EB3 I-140 filed on April 27, 2004 be adjudicated at the same time as a concurrently filed EB3 I-140/I-485 filed on April 27, 2004?)

USCIS Answer: There would be one PTR date for I-140s filed as stand alone and concurrent filings. However, if the case is a concurrent filing, the I-140/I-485 packet will be pulled when the I-485 is adjudication ready (fingerprints and/or name checks have cleared). If the I-485 is not adjudication ready, the I-140 will not be pulled for adjudication based on the I-140 processing date.

Question: Does "concurrently filed I-140 and I-485" mean both forms are filed at the same time? If an I-140 is filed on April 27, 2004 and the I-485 is filed on May 20, 2004, under the concurrent filing regulations is this filing sequence - here only a few weeks apart - considered a concurrent filing for these purposes?

USCIS Answer: For the purpose of implementing this memo - concurrent filing means any I-140/I-485 filed at the same time or a subsequent I-485 filing pursuant to a pending I-140 if no adjudicative action has been taken on the I-140.

Hot !!! CHANGES TO USCIS PROCESSING OF I-140s/I-485s ?Effective April 30, 2004, USCIS is going to be doing concurrent ADJUDICATION of concurrently filed I-140s and I-485s:

USCIS issued an Interoffice memorandum dated March 31, 2004, signed by Fujie Ohata, Director of Service Center operations, which was faxed to AILA attorneys this April 20th morning at 8:42 a.m., and this memo confirms that the USCIS has modified the current adjudicative process for the concurrently filed I-140s and I-485s. This is a major change and it is a change for the better.

This memo instructs the USCIS to adjudicate the concurrently filed I-140 and I-485 together. This means that for purposes of measuring and reporting the processing times, the I-140 processing times will control. In other words, a concurrently filed I-485 will no longer be tracked based on the local I-485 processing times. Concurrently filed I-140s and I-485s will be considered to be a separate work load from the current stand alone I-485s.

From a practical standpoint, this means that the long processing times for I-485s may be over, because the USCIS will have to open and adjudicate the I-485 case at the same time as the I-140 case, and the processing times for I-140 adjudication are in the 2-8 month time-frame as opposed to processing times for I-485 adjudication, which have been more like 20-30 months, depending upon whether the case is filed in NSC, TSC, CSC or VSC.

The effective date of this concurrent adjudication is April 30, 2004.

More from AILA: Effective April 1, 2004, the I-140 process was moved into the Residence Product Line. This was done to facilitate the concurrent adjudication of the I-140/I-485's, which will take effect April 30, 2004. This change is not part of the pilot program to adjudicate I-140/I-485 adjudication within 75 days of filing.

EB stand-alone adjustments will continue to be processed, but it is anticipated that processing times will slow as the NSC works two tracks of EB adjustments.

NSC will soon be advancing the PTR dates for EB adjustments. Once less than 10% of a month's cases are still pending, the PTR date will advance to the next month. It should be noted that a small percentage of cases filed prior to the PTR date will still be pending. These are generally cases with expired prints, or more significantly, with pending FBI Name checks.

NSC is currently preparing all EB adjustments for adjudication which were filed December 2002 or earlier. Cases are deemed "adjudication ready" when fingerprints and the FBI name checks are completed. The NSC Contractor reviews all cases filed in December 2002 or earlier on a weekly basis to identify every case ready for adjudication, or conversely, every case with newly expired fingerprints requiring fingerprint rescheduling. This process ensures cases are brought to the adjudicators as quickly as possible and that older cases do not get overlooked.

Most cases filed prior to December 2001 which are not "adjudication ready" are held because of problems with the FBI name clearance. At the NSC there are approximately 2,200 cases filed prior to January 2002 which have not been cleared for adjudication. There are over 24,500 cases filed between February and December 2002 that are waiting for clearances. Again, the NSC sweeps "on deck" cases weekly to move the I-485s that have completed the mandated security clearances to adjudication.
