background checking pending and administrative closed

:mad: My 485 pending for about 3 years (I-140 is NIW and 485 receipt is 12/2003) and background check is still pending. I recently visited the local immig office and supprised to find out that my case is "administrative closed" on 5/26/2006 and background checking is still pending. The officer just said she will ask them to reopen the case and send me a letter. I didn't get any letter yet now. Did someone know or experience the "administrative closed"? The ordeal is too long. I must run any risk to push my case to the end. I will file the lawsuit. Can anyone tell me the consequence of the lawsuit to USCIS? How long will I get a result from the lawsuit?

BTW: Check out my signature... I'm seeing a pattern here. Sometimes I think it's better to receive an RFE because you know your papers are being worked on. Further, once they get the RFE, you can count anywhere from 7 to 10 days to get an approval (that is if you get to answer all the RFE properly).

Thanks! Here are our RFE details:
Wife: Birth Certificate (submitted true certified copies of her Birth Certificate from the national statistics office of our country)
Mine: RFE #1: Proof of lawful status from April 2003 to present. Submitted: W-2 (2003, 2004 & 2005), last 6 paystubs and H-1b approval notices from 2003 to present.
RFE #2: Proof of lawful status from January 2000 to April 2003. Submitted: H-1b approval notices from 2000 to 2003, copies of I-94 from entry to present (front and back copies).

So are there people whos dates are current and for sure name check has been completed, waiting for 485 approvals?

Question regarding EAD

So, once you get your EAD, can you go on to take a totally different 2nd job (part-time) while continue working for your current employer?
 
You could. But it would cancel out your other visa status(H-1) or whatever. And if something goes wrong with your 485, I think you'll be instantly out of status.

i think lot of people waiting for their 485 approvals
not many 485 approvals from last 2 week

I know, after an enormous progress in the first week of October, TSC has cooled off little bit. Not sure why :confused:

Hope they will pick it back up :eek:
 
Yepp...counting days. Are we suppose to send the I-140 approval notice to USCIS even if it was a concurrent filing? My lawyer thinks yes...but she has been wrong before :eek: :eek:

I am not sure what you are asking, looking at your signature it seems you have done a concurrent filing. Are you asking, after I-140 gets approved, do you need to send that notice to USCIS?? If thats the questions, then I dont think so. But, if you want to go ahead and send it, it shouldnt hurt :eek:
 
No - not really.
But again, if you want to send it, more power to you.
Especially if your Priority Date is current, may be it will make them act on your I-485 sooner.

I filed concurrent filing and applied for EAD and AP for my spouse only and got an RFE for spouse's EAD saying that they cannot find the associated I-140 approval and they wanted the copy of approval notice for processing EAD.

We sent it last week. I don't think sending I140 approval will expedite anyone's case. If it was, then I should have got GC approval. They will get to it when time comes. not when I-140 copy is sent. :--)

That sounds like similar to what so-called semi-concurrent filing is meant for, from what I hear (although, in that case, it's not the 140 approval notice but the 140 receipt notice that you are supposed to submit along with the 485 applicaiton). We filed semi-concurrently, and that's attorney's preference. She thinks it helps expedite the process. I don't know if it really is the case, but I do have read similar explanations somewhere online before.
