Yes, this labor was filed in the past and I140 for that individual was rejected. Later it was filed on my behalf and it went thru fine.

And, also I just checked the PD on the I140. Yes it is Oct22'05 and not Nov'2001.

Am i screwed?

You said, your's is Substitute labor. Are you sure that your employer never filed I-140 prior to some one on this labor. If any time I-140 approved for that particular labor certification and If you are using the same labor for your I-140 then your PD is your RD Date. (I hope you are not confused here with my statement...)

Here's the sequence I had followed -


1. Dial 1-800-375-5283
2. Select 1 (for English)
3. Select 2 (for case that you have already filed)
4. Select 6 (to check on the status of your case)
5. Select 1 (if you know your receipt no.)
6. Enter Receipt No.:srcxxx-xxx-xxxx
7. Select 1 (if your receipt number starts with SRC)
8. Select 1 (if receipt number entered is correct)
9. Select 3 to continue to the next step
10. Select 4 (filed several related cases together) to speak to a TSC representative

i don't know, maybe cause your Receipt date is just this August of 06. Or maybe your priority date is recent.

What was your RFE about?

I also noted LUDS on 10/11/2006 and 10/12/2006 but on
an approved I140 that was approved on Sept 15,2006
and original LUD was Sept 17,2006

Interestingly my I 485 got LUD on Sept 29,2006 and then
Oct 1,2006.

Hi IMQ,

I-140 was filed earlier on this labor and it got rejected for that individual, If this is a reliable information then your PD is Jan2001 or Nov 2001 (I didn't figured your PD from your postings). Anyhow whatever your PD should be 2001.

If I-140 got approved for that individual, then USCIS will treat your I-140 filing date as your PD.

First of all, you would have noticed your PD on your I-140 approval. Your approval letter should say correct PD.

But don't worry... it can be corrected. There are lot of people got this kind of issue and it got resolved by sending letter. Ask your lawyer to send the letter about the correction of PD date. Just do it... otherwise you won't get GC for 4 years. Your 2001 PD is most postive point now for you in these retrogression days.

I am jittery about this thing for two reasons -
a. We did not catch the PD error on I-140 for almost 1yr
b. And, its substitution labor case

Hi imq,

Send the letter with confirmation deliver receipt. Also track the letter about tracking and who signed the letter. Once letter recieved over there, keep on eye on your LUDs. I hope your LUD should change some time later. Also try to call them also.

Schedule A merge with EB3 ???

Earlier primarily registered nurses, physical therapists used to file their GC application under EB3. In May 205, US Govt. to ameliorate the shortage of nurses and physical therapists in the United States, granted 50,000 visa numbers exclusively for them and made a separate category called Schedule A. This was one time allotment.

Unlike other categories in the DOS Visa Bulletin, once the Schedule A numbers are all used, no more will be issued unless the law changes to increase the quota again.

If the Schedule A numbers are depleted, these cases will be charged against the regular employment-based, third preference quota (EB3 visa numbers), as they were before. If this happens, existing and future applications from primarily registered nurses and physical therapists will be considered under EB3.

Confusion about Receipt Date..Please help

Guys
The receipt date that my lawyer tells me is 5/5/2006 and uscis website tells my receipt date as June 16 2006. Is there a reason why I see this...Is it possible to tell USCIS to fix this problem...Its been a long wait guy just want to get over with this...........

Its almost certain to be mass LUD. I too got it on my approved I-140 and approved AP! Not on I-485!

This may be some sort of system udate?
