Your attorney is 'Wrong" . You will be affected by retrogression like everybody else if you are from India / China. The advantage you will have since you filed I-485 before Oct 1st 2005 is that you (and your spouse) will be eligible to receive your EAD and you will also be able to switch jobs after I-140 approval and I-485 is pending for 6 months or more using the AC21 provision.
You will have to endure the same waiting time for the final greencard which depends upon the visa number being current.
