May be better with FP

Infact the news may be sweeter if you have already completed the FP. TSC is approving both 140 and 485 together for those cases where FP is done.

I guess the day of LUD change means they work on the case on that day. It's better to see LUD change recently, probably meaning that they work on the case again.

Why not. It won't hurt. The earlier you start, the better.

LUD change insignificant for soham13

In case of Soham13, the LUD chnage is about a year old now so I don't see how that conveys that they are working on his case. If his LUD has changed in last couple of days that this is the case.

When I filed my 140 in December last year, the LUD changed twice in December itself and than again in January when I filed 485/EAD/AP. Since that LUD for 140 is Jan'04 itself.

If soham applies for 485/EAD/AP he will see a LUD update on 140 also and there might be a chance that he will get his 140 approved when they pick it up to verify it before admitting the 485 application.

My lawyer tells me that.....

they are working on getting FP for all 2002 cases. Yes, 2002. And I was told it's hard to predict on my case and I was fortunate enough to have FP done already. See my status above.

So far, my lawyer has seen only 2 (two) concurrent cases approved so far. By the way, my lawyer is a very good one with some fame. I am pretty sure they have plenty of cases going on.

Concurent filing WORKS!

I cannot believe it!

Today! All my I-485s... (me and my family just got approved... (on the web site))

2 days ago; I received an email (from the uscis portfolio automatic processing thing) that my I-140 was approved... (See Page 13 of this thread for more info)

My FP were done on 5/3/03 (14.5 months ago) and I was now thinking: (Even if they did not concurrently process my I-485 the stressful part was over (I-140)) So I was ready to wait another 18 month or so and file for my H1B extension soon. (My lawyer told me that they were not 100% ready implementing the concurrent processing... I guess they were! :) )

But no! Everything is done! FINALLY! WHOOHOO! :D :D :D

I-140 - RD: 3/11/03, AD: 7/9/04
I-485 - RD: 3/11/03, Fingerprints 5/03/03 ... AD : 7/14/04
EB-2 Concurrent (NIW) - Employer Sponsored

(My LUD was 5/29/03 all the time till 7/12/04 when everything started)

Here is some advice my lawyer gave me!
1) Do not send/harass the INS with inquiries... if you need something ask ME (my lawyer)... Only 1 inquiry sent was recently!
2) Be very patient! (that's why I did not care to wait another 18 months or more... but it is very nice to get it all resolved!)
3) Do not do anything without my approval (I asked about letters/fax etc.. she said : Worthless!)

Looks like the FP expiry date is the trigger for I485 approval. Most of the I485 are being approved to avoid repeated finger printing notices. So, we could expect this trend to continue ....and that should bring the I485 processing times close to Mar-May/2003 and I140 times are in May,03.

This means, they are doing good job bringing the times for I140 and I485 together. To make this happen I140 processing becoming little slow..(15 days progress in 15 days....)

Did not see 04 FP

My attorney also said that TXC is doing much faster on Finger Printing, but I saw no recent FP notice on any 2004 filers. It is true that FP is the landmark we can use to gauge the proximity of 485 approvals, since the officer will not approve 485 until it is ready for adjudication, meaning name checking and FP have to be done. To avoid repeating FP, TXC is trying to do the FP close to the time they could work on 485.
 
developing trend at TSC

One thing is great happening at TSC. People who have their FP done are seeing concurrent 140 and 485 approvals. This means TSC has adopted the Fujie memo completely. Now another good thing is that they are not asking for FP if case is not near the adjudication. This is another indicator of progress for us. If the folks who have filed concurrently / semi-concurrently get a FP notice, for sure their case will be approved within 6 months of FP. This is true only for those cases whose FP is scheduled after 30th April when Fujie memo came into effect.

So what do you all say ???
