Problem with Form I-797, Please do advise

First of all sorry to post here too But I know there are so many guys dealing with 7th or 8th year extension and there so many experienced user. So please help me

Hi,

Recently I received approval for my 7th Year extension. I am planning to revalidate my visa from St. Louis.

There is small problem on the Form: I-797. At the bottom of approval notice where they provide new I-94 card, somehow I-94 # is missing from both side (bottom left and right portion) of approval notice.

I spoke to my attorney on this issue and she advised me not to worry about it. She said

“This is a small glitch on their system but they have you properly documented, and the petition which we filed is also have you properly documented. Therefore it is unnecessary to re-apply requesting any correction.”

She also advised me to continue with my plan with revalidation.

Guys please advised me what I am supposed to do. In case if someone already had this issue.

You can request the copy from INS and will take 14 days to come.

When the lawyer filled my ads and LC application, they filled it as BS+1year, while I had MS+4years. So I asked my lawyer what was the reason behind this because doing more would get fewer response and the case would be stronger. The reason that he gave is that for MS+4years you need to be paid right amount of dollars and doing the right kind of job. You might have a Phd, but if you are paid like a secretary, then that is what you have to go in as.

From an employer stand-point for lower price he gets more for his money, so asking more money is against his business thinking (also, if he knows you are stuck with him for GC situation, oh he better make good of you).

For my case, I made a mental compromise because of my salary and timing. As for your case goodphysq, if you had a great salary and your lawyer put BS+0years, then the lawyer is the one who messed you up and didn't give you a fair story/reason (out of his inexperiance or stupidity or greed).

So when you look at it from the labor department stand-point. A local person makes 85k for the same job you get 60k. So you get 25k less, which translates to you are not as good as the local guy. While the real story is that you undercut the local guy or took less for stability and doing the same job for much less, and the business-owner loves you for that. The other situation is also true, where the job requires only a HTML programmer, but you took up the job even though, you could write the windows architecture, but he pays you fair price for HTML work that you do.

My advise to all the people who are planning to go in for your GC, please make sure you are paid right to your qualification. If you are paid less, not only you are making less money and doing a compromising job, but when you get into shoes like goodphysq, myself and many others, you will run into this frustrating situation and your life will hang by a thread. This is a very long and frustrating process, and living with this worry everyday is hard and breaks you down much faster than you can imagine.

Also find an employer who appreciates you for your work and knows how to do/run business and is smart. If the business owner is not smart and doesn't know how to run the business, then he is not going to make profit and is always going to be on the losing end. If this business closes or lays-off then also you are in a much more deeper soup, where you will worry for the basic job. Also it is easier to deal with a smart/sensible employer.

The key is - stability + money + happiness + satisfaction + patience - is going to get you through this situation. :)

Labor Experience question...

When my labor was filed, on the ETA-750 form minimum experience and education was shown as Bachelors degree + 2years of experience.
And my experince was shown as From 97,May to current date(Date when I filed was June,2002).If I exclude the current employer experince I will have 3 years and 6 months experince and If I incude I will have close to 5years of experince as of June,2002 which is the date my case was filed.

I have following questions

1)When experince is considered will they take the experience from the current employer from where I am filing my GC or not ?

2) So my experince is considered as 3.5 years or 5years ?

3)carlson memo states we should have bachelor degree + 3 years experince.
Is that candidate should have that qualification and experince or it should be requirement for any position?

Any help on this will be appreciated.Thanks in advance.

Current Employer exp is not accounted for LC. Only your previous exp.

Carlson memo requirement was BS + 2 yrs. It is the basic requirement for the position you are trying to prove that you are fit.

AVM has good news today,, DOL is processing Dates for California RIR is July 2002 to Jan 2003.. finally, after a loooooooooooooooooooong wait its 2003 !!!

Does this mean that DOL is "over-the-hump with the remanded-cases backlog? Has any of you who has monitored this for some time start to see a pattern of 1 day's LC getting cleared in DOL? Is it faster or slower?

I have a LooooooNG way to go (RD 3/2004)...but it would be interesting to see a pattern.

I wouldn't go that far. Don't put too much hope in DOL. The less you hope, the less frustrated you will get....

I've just heard from AVM that our (actually, my husbands') case is certified.

DOL RD date 01/03/2002.
DOT Code : 999.151-032 (Computer Software Engineers).
The case was certified on May, 22 2004.
No NOF in SESA and DOL.
Small Company in Bay Area with no Layoffs.

2 or 3 people that worked in this company, were certified too (with the same DOT code). Their DOL RD date was on the end of December.

Do somebody knows about the forums concerning our next steps (I-140, etc.)?

This forum helped me a lot. Thank you everyone for all the info. Good Luck to everyone....
