Most likely they will reject it (as happened to my case).
Not straight away though: it took them 6 months to make a decision :(

My lawyer submitted market retest response 4 months ago, but we have not heard anything from DOL yet.

NOF on my RIR application was issued in Feb 2003.
The lawyer opted for the marked retest (without even consulting me).
The application was finally denied in August. The lawer would not appeal.

I work for a large company that doesn't hire and laid off a bunch of people.
 
Labor Substitution required for Digital/Asic Design Engineer

Does anybody know of any company that has Labor Substitution available for Digital/ASIC Design Engineer. I have a Bachelors and a Masters in EE and have been working for 3 years. I am based in Texas and this Labor Cert. process is pretty frustrating.

Please reply if you have any leads.

Try to move to Bay ARea. Here, I-140 seems to be moving.
You can try companies like Intel, Sun etc. I am sure that they
would have some labors available.
ALso, you can try some CAD companies like Magma, Cadence,
Synopsys etc.

I believe that in Bay Area I-140 is really moving. For EB2, it is now July
17th, 2003 (or maybe May 5th, 2003). For EB-3, somthing like March, 2003.
Every month, they are making some progress.
Only Labor is stuck and getting remanded. I am also a victim of remand.

Try to find out if your company has any approved labor available for you to
use. That might be only light at the end of the real dark tunnel.

I doubt these big companies have "labor for substitution", usually these companies follow the rule to the book, and withdraw applications when the person for whom the petition is filed no longer works for the company. And also they file the petition more tailor made than the regular software companies... Almost all these companies have also laid off people (sun is a BIG no no for GC right now), so getting labor approved may be difficult too.

DOT Codes

Can someone post the link to the DOT codes? My case may be certified (one of my companies case is certified) on the same date mine was transferred to DOL and I want to check if its mine.. There is another one on the next day which is just received...

Yes, I am trying for the substitution. Hoping that will work. Really don't
know what's going to happen when BCIS reviewes my application.
ALso, I am not withdrawing my old labor application. If some miracle
happens and DOL approves of that, then I can use thar also fro I-140.

I know it is hard to get something positive from INS/DOL etc.
Let's just try different things and keep our fingers crossed.

May be not. I know a person who filed I-140 with substituiton labor and approved from a big company in Bay Area. That company recently changed it's name.

And for jillusapota's skill set I think there are good chances. But its not a good idea to move to Bay Area unless there is solid chance of getting the Substitution LC.

friend's company? I am also ina similar situation, so wanted to find out if
my company profile is similar to your friend's company?
 
A friend of mine got his labor approved !

A friend of mine got his labor approved last week. His was an EB-2 case,
in Bay Area, company size (~3500), some layoffs (not large-scale).
His case was not remanded. Was filed 2 years back.

At least somebody is happy ... (and he took me for dinner :)
 
Anyone knows the status of non-RIR cases?

ANy idea what is happening with non-RIR cases? Mine was filed on May 28, 2001
 
About Non-RIR cases ...

My lawyer said that to reach May 2001, INS will take at last another 18-24 months :(

Anyone whose case was remanded to State and then approved?

Rec'd in DOL: Nov 4, 2002
Remanded to State: Oct 2, 2003

Hi Folks


Everybody is frustrated and opening a new thread.The thread count only increasing!!!!!.Now really what is the situation for remanded RIR Cases??Guys i think that remanding is only in SFO Area!!!!.In other states most of my friends have filed for 485.
what is this stupid DOL is doing ??I dont know.
