DV 2023 AOS (Adjustment of Status) Only

Based on the above responses, I believe the second rejection was an erroneous one - the package was probably handled by a new contractor at the Lockbox. The green paper should have informed them the package was being expected. So going forward you have two options:

Option1: Send everything back as is to the same Lockbox in Dallas, but this time around include (a) copy of your selectee notification letter, (b) copy of the acceptance notice (I-797) for your own case - this will show the case is tied to yours and will hopefully cause them to fast-track it to join yours at the FO, (c) a cover note explaining: (i) this package is for your derivative, (ii) your case as the main selectee is currently being processed evidenced by your attached I-797, (iii) your FY is not yet over contrary to what the rejection notice states, your FY ends on Sept. 30th, 2023.

Option 2: Fill out new sets of forms and send this package as a new one to your actual Lockbox (Chicago, I believe based on your zip code?). This will however require you to include a sealed medical report (you will not be able to use the copy previously sent since it has been opened), and new payment form. You will also need to include (a) copy of your selectee notification letter, (b) copy of the acceptance notice (I-797) for your own case - this will show the case is tied to yours and will hopefully cause them to fast-track it to join yours at the FO, (c) a cover note explaining: (i) this package is for your derivative, (ii) your case as the main selectee is currently being processed evidenced by your attached I-797.

I do not believe it is too late, give it your best shot and hope for the best. Third time is a charm, like they say :). Whichever option you decide to go with, I highly recommend you send in the package with next day courier delivery option (I don't think same day option is available, or I would have recommended that).

The case processing continues as is regardless of your spouse's since you are the main selectee.

p.s. I suggest you add your case data to the timeline spreadsheet by the way.

Thank you so much for your response! I think I will go with the first option because Dallas seem to be responding quite quickly. I am just worried that the same person won't pay attention again. So I think I will write the cover letter in blue pen so they notice and read it.

Should I send a second copy of the I-485 in addition to the one with the markings at the bottom just incase? I'm worried about that blue line across the markings on the first page.

Also, yes I'll add to the timeline. I dont have excel on my computer but I can use my husband's when he gets home.

Is it mandatory to bring the original college certificates to the interview? My original certificates are in my country, here I only have colored copies and their respective translations into English. can you enlighten me please
I strongly believe nobody likes to feel like people are taking advantage of their generosity, you know? When I'm spending my time helping out folks here, following up on their cases (without any prompting) and rooting for them to succeed, I do expect them to do me the common courtesy of responding to questions about their cases when I ask follow up with them.

You honestly expect me to answer your above question when you couldn't be bothered to respond to my genuine attempt at following up with your case in this post? Nope, it doesn't work that way, I'm sorry

You can include a new copy if you like.

The Timeline spreadsheet is s Google document, you do not need to have Excel installed on your machine in order to access or update it.

Sorry mom. The USCIS rescheduled my biometrics for August 3rd, but they called me on July 17th and I went to the FO and had my biometrics done the same July 17th. No updates so far.

While the IO may or may not request to see the original documents, there is an expectation for all applicants to attend their interview with the original version of all the documents submitted in support of their application. This is something you should have arranged to be sent to you long ago.

I have not yet received any update on my case since biometrics and finger prints taken which was on April 10th.
based on a recent congress inquiry response which was more indicative of a potential interview waive, should I still expect to get an RFE for medical docs within the next month?
And in case I get an RFE how soon would they get back to me?

I just added my information on the excel. I gave my biometrics and finger prints at June 28th and didn't receive my interview yet. I reached out the congresswoman in my area and initiated congressional inquiry already. I haven't reached the senators, planning to do that next week because I didn't want to overwhelm the USCIS with my case at this point.

Is there anything else I can do? I am worried about the quota.

Thanks for helping us a lot, I really appreciate your kind efforts.

1. Yes, you should expect a RFE or the interview letter itself in your specific case like I’ve already told you before, I believe. Your case will not be approved without the medical report.

Like the post I just responded to above, if you take a look at the Timeline spreadsheet, you’ll notice a couple of other cases from your FO, who filed before you, are equally still waiting for their next updates, you’re not the only one waiting for this from the Brooklyn, NY FO. Your FO unfortunately seems to be bunching up DV cases and waiting towards the end of the FY before adjudicating them - they’ve done exactly this same thing in the past.

Suppose you filled "No" on the section asking if your spouse is coming with you, can you proceed to file form I-824 for FTJ after approval?
 
Did you indicate on your DS260 that your spouse will be processing FTJ or not?

Anyway, regardless of what you indicated on your DS260 form, the FTJ process must be completed by the end of the FY. Looking at the way things are going, I do not think you’ll have enough time to get the I-824 approved in order for your case file to get forwarded to the embassy to enable your spouse get scheduled for an interview there.
I did not file form DS-260. I filled "No" in form I-485

So KCC is not aware your spouse will be processing FTJ. Anyway, if you don’t mind the possibility of loosing your FTJ filing fee, you can give it a shot. I however doubt you’ll have enough time to complete the process before the FY is over.

No, an address change at this point will actually cause more harm for your case. It’s not like your case automatically gets reassigned to a new FO following a change of address. The case will will only get reassigned after the IO at the current FO reviews/or is ready to adjudicate and then discovers you’re no longer under their jurisdiction. That is when the case gets sent back to the NBC for reassignment.

This is great news. Congratulations and thanks for the update. Did you have any other status outside of your asylum pending one? And was the asylum case discussed during your interview?

Do keep us updated on the FTJ progress/outcome.
 
There are two of your from the same FO, filed within 3 days of one another, you've both completed your bio and are both waiting for your IL/next update at this point. The response you received from USCIS while related to your case, is not specific to your case alone.

Since your case was only filed about a month ago, I doubt if your congressional office agency liaison person will be too enthusiastic to initiate a follow up on your behalf at this point. But I don't want to discourage you from initiating the congressional case assistance at this point if you feel inclined to do so, miracles do happen.

I cannot be specific as to "how long" because I do not want to create an impression for folks in terms of what a standard wait period should be. Again, you can see other folks who filed long before you did from the same FO as you who are equally still waiting, and they've equally initiated congressional inquiries at one point or the other which I think you should be able to find on this thread if you search for them.
