DV 2023 AOS (Adjustment of Status) Only

Yes she said I can call her back on the number she called from! I haven't tried it yet and I don't see a change on my USCIS account to reflect an interview so I should probably call her tomorrow to make sure?
It is quite normal to not see any update following interview schedule, so I wouldn't worry about it for now. I would say to give her until Friday or Monday before reaching out to her again, if there's still no interview letter by then.

NOTE:
You may receive PMs from other folks from your FO asking to share the phone number she gave you with them. I would caution you be very careful with doing so - that's all I'm going to say at this point.

Which I did not send as I am the winner and they kept my package and cashed my cheque (which has the congratulatory letter). I did not think to send another copy. What do you think it means when they say the fiscal year has ended? Is it too late to send it back, even thought they are processing my application??

Should I send back immediately tomorrow?? And if so, should I fill out tje I-485 again and everything else to minimize them getting confused they are processing my application??

Hello, how can I fill the timelines spreadsheet? I have been waiting the bio notice for 3 weeks. On 14th July my fingerprint fee is accepted and on 17th I got sms. Should I call USCIS or ACS next week if notice doesnt show up this week?

Hmm, interesting. Couple of questions first (to help figure out what’s going on and decide on the next steps):

2. The initial package that got rejected the first time, did the documents have some sort of markings on them from USCIS?
3. Did you simply include the missing signature and sent back the same forms, or you downloaded new forms and sent them in place of the ones that got rejected?
4. Was the I-693 medical report opened when the first rejected package got sent back to you?

1. It was a green paper. Yes, included it and placed it on top of package.
2. Yes, the I-485 had a series of numbers/letters across the bottom of all pages. I also noticed they have written my husbands name and "I-485" on the back of the passport photos.
3. We just sent back the same forms (with signature) as I thought maybe the numbers meant something to them.
4. Yes, the medical report was opened. Your last reply to me said to send back as is.

Some additional things:
a) The money order has a stamp that says DHS and at the bottom of the cheque they have written a date in pen.
b) the package that was just sent back, the entire thing is stapled together (including the first green slip and now the second at the top)
c) The markings at the bottom of the I-485 are across the bottom of all supporting documents ie birth certificate, medical report, etc.
d) I have since received two letters from USCIS, one saying they are processing my case and the second waiving the biometrics.

Should I send back everything again with DV letter plus letters addressed to me? Should we send another copy of the I-485 without markings in addition to the original? Or is it all too late being August?? Also, will they still process my case or is an officer somewhere waiting for my husband's package before they move with my case??

Based on the above responses, I believe the second rejection was an erroneous one - the package was probably handled by a new contractor at the Lockbox. The green paper should have informed them the package was being expected. So going forward you have two options:

Option1: Send everything back as is to the same Lockbox in Dallas, but this time around include (a) copy of your selectee notification letter, (b) copy of the acceptance notice (I-797) for your own case - this will show the case is tied to yours and will hopefully cause them to fast-track it to join yours at the FO, (c) a cover note explaining: (i) this package is for your derivative, (ii) your case as the main selectee is currently being processed evidenced by your attached I-797, (iii) your FY is not yet over contrary to what the rejection notice states, your FY ends on Sept. 30th, 2023.

Option 2: Fill out new sets of forms and send this package as a new one to your actual Lockbox (Chicago, I believe based on your zip code?). This will however require you to include a sealed medical report (you will not be able to use the copy previously sent since it has been opened), and new payment form. You will also need to include (a) copy of your selectee notification letter, (b) copy of the acceptance notice (I-797) for your own case - this will show the case is tied to yours and will hopefully cause them to fast-track it to join yours at the FO, (c) a cover note explaining: (i) this package is for your derivative, (ii) your case as the main selectee is currently being processed evidenced by your attached I-797.

I do not believe it is too late, give it your best shot and hope for the best. Third time is a charm, like they say :). Whichever option you decide to go with, I highly recommend you send in the package with next day courier delivery option (I don't think same day option is available, or I would have recommended that).

The case processing continues as is regardless of your spouse's since you are the main selectee.

p.s. I suggest you add your case data to the timeline spreadsheet by the way.

Is it mandatory to bring the original college certificates to the interview? My original certificates are in my country, here I only have colored copies and their respective translations into English. can you enlighten me please

Thank you so much for your response! I think I will go with the first option because Dallas seem to be responding quite quickly. I am just worried that the same person won't pay attention again. So I think I will write the cover letter in blue pen so they notice and read it.

I strongly believe nobody likes to feel like people are taking advantage of their generosity, you know? When I'm spending my time helping out folks here, following up on their cases (without any prompting) and rooting for them to succeed, I do expect them to do me the common courtesy of responding to questions about their cases when I ask follow up with them.

You honestly expect me to answer your above question when you couldn't be bothered to respond to my genuine attempt at following up with your case in this post? Nope, it doesn't work that way, I'm sorry

You can include a new copy if you like.

The Timeline spreadsheet is s Google document, you do not need to have Excel installed on your machine in order to access or update it.

Sorry mom. The USCIS rescheduled my biometrics for August 3rd, but they called me on July 17th and I went to the FO and had my biometrics done the same July 17th. No updates so far.

While the IO may or may not request to see the original documents, there is an expectation for all applicants to attend their interview with the original version of all the documents submitted in support of their application. This is something you should have arranged to be sent to you long ago.

I have not yet received any update on my case since biometrics and finger prints taken which was on April 10th.
based on a recent congress inquiry response which was more indicative of a potential interview waive, should I still expect to get an RFE for medical docs within the next month?
And in case I get an RFE how soon would they get back to me?

I just added my information on the excel. I gave my biometrics and finger prints at June 28th and didn't receive my interview yet. I reached out the congresswoman in my area and initiated congressional inquiry already. I haven't reached the senators, planning to do that next week because I didn't want to overwhelm the USCIS with my case at this point.

Is there anything else I can do? I am worried about the quota.

1. Yes, you should expect a RFE or the interview letter itself in your specific case like I’ve already told you before, I believe. Your case will not be approved without the medical report.
2. I have no idea.

By the way, if you take a look at the Timeline spreadsheet, you’ll notice a couple of other cases from your FO, who either filed around when you did, or after you did, are equally still waiting for their next updates, you’re not the only one waiting for this from the Brooklyn, NY FO.

Your FO unfortunately seems to be bunching up DV cases and waiting towards the end of the FY before adjudicating them - they’ve done exactly this same thing in the past.

Thanks for the reply. So that means Brooklyn, NY FO is putting me in quota limit danger for this year. Also I most likely to wait for September if they do it like they did before. Changing my address at this moment may help me to receive an interview before the FY ends?

Suppose you filled "No" on the section asking if your spouse is coming with you, can you proceed to file form I-824 for FTJ after approval?
