No, it will not cancel the existing EAD.Hi, if i am gonna apply for AOS and i will include the i765 form and i already have EAD expires in may 2022, that will cancel my current EAD once i fille my OAS, even if it still active till may?
Sometimes I don't understand the logicThat is an overkill, not necessary for a DV based application.
There is a delicate thin line between case front loading and providing unsolicited information which more often than not creates more issues and may sometimes lead to a case denial. Having a good understanding of the type of application being filed is a starting point for figuring out if the unsolicited information being provided could positively or negatively impact the application.Sometimes I don't understand the logic
When is oversharing good? When doesn't it make sense?
Drexler have you revised the AOS SPREADSHEET? All of the important information is there. In addition, you can use the DV 2022 Timeline for timing reference and update your case info. Hope this helpsHello, I wanted to make a query, it happens that I am selected in the lottery draw and I have not had an answer after I sent the documents, I do not know much about the subject because nothing has reached me, I do not know whether to worry because nothing arrives or keep waiting
I am of Venezuelan nationality
OP is processing CP, the AOS process spreadsheet is not applicable to them. OP’s post has been moved to the CP thread.Drexler have you revised the AOS SPREADSHEET? Thanks for the clarification!OP is processing CP, the AOS process spreadsheet is not applicable to them. OP’s post has been moved to the CP thread.
Doesn’t matter. As long as the letter is signed by a company official/representative with the capacity to do so.My company recently terminated our HR Director and I'm not sure when they are going to be bringing a new on onboard. If they haven't hired a new one by the time I send my AOS Package, would an Employment Verification Letter signed by my direct supervisor be ok?
I’m sorry to learn of your father’s sudden passing.Hi Everyone,
Yesterday I have received a text message from USCIS that my case was received. I am currently on H1-B (never went outside of USA for stamping).
Also I have not included advanced parole paper with my application.
Terribly, this morning I found out my father has passed away. I am looking to travel back home in next two days to be with my family and was wondering if that could impact my AOS application negatively. I know USCIS is mailing me the I-797 Official Receipt notice, is that where the biometrics date would be shown for me? I am planning to come back in 2 weeks so it not be good to miss that appointment.
I am just looking for your advice and if someone maybe was in a similar situation.
Thank you.

Unfortunately once you leave the US without an approved AP while your AOS application is pending, that application is effectively considered abandoned. Doesn’t matter if you subsequently receive a bio and/or interview notification after the temporary trip, the application will be subsequently denied as you would have been deemed to have abandoned the pending application when you left the country.
Obviously you need to travel back home to be with your family at this time. The good news is you’ll still have enough time to re-file the AOS application when you return back to the US. Hopefully you still have a valid stamped visa on your passport to enable you re-enter
Yes, that is true since H1-B is a dual intent status. Are you currently on H1-B? I was under the impression you were still in OPT-Stem. Do you already have the H1-B stamp on your passport though? Thanks mom for quick response. I have read online that if you are on H1-B status, that your I-485 pending application would not be considered abandoned even if you dont have advance parole submitted. Is this false information? Since I have seen it on multiple websites..\
Thank you again
I have approved H1-B and that is my current status. I just have not been outside of USA since then to get a visa stamp in the embassy thats what I was referring to in my first post.Yes, that is true since H1-B is a dual intent status. Are you currently on H1-B? I was under the impression you were still in OPT-Stem?
You responded to my post while I was updating it to ask about H1-B stamping. So you will need to issued with the H1-B stamp in other to return to the US in that status. You'll be fine in that case if you re-enter with H1-B.I have approved H1-B and that is my current status. Understood. Thank you as always for the adviceYou responded to my post while I was updating it to ask about H1-B stamping. So you will need to issued with the H1-B stamp in other to return to the US in that status. You'll be fine in that case if you re-enter with H1-B.
Sorry one more thing...Yes, that is true since H1-B is a dual intent status. Are you currently on H1-B? I was under the impression you were still in OPT-Stem. Do you already have the H1-B stamp on your passport though?
That is precisely why I kept asking about the H1-B stamp. I have no idea on how to get an expedited visa stamp appointment.Sorry one more thing...
Right now Im sure you know because of COVID that there is a huge backlog in the US Embassies and people wait months to get an appointment. This worries me since If I cant get my H1-B stamp in time to come back for bio and interview, then I would miss them.
Is there some kind of request I can submit that this is an emergency to maybe get me a interview in the embassy quicker (for H1-B stamp) ?
Thank you.
1. Abandon the asylum application by returning home to process DV selection with your husband via CP. The caveat here is if you abandon the asylum application and depart from the US, you may trigger a 3 or 10 year ban for overstaying (depending on how long you’ve been out of status). OrHi @Britsimon @Sm1smom I have a unique question I am currently in US with pending Asylum case, my husband won greencard and he is in our home country, Not sure but have been told my visa is out of status what should I do on my end
