This is actually not a big deal, and no, your entire application will NOT be denied because of this. Your daughter is a derivative. If submitting the DS260 form, just make sure you enter the correct DOB for her. Also when submitting the AOS package (as I’m assuming you’re planning on processing AOS), just be sure to enter the correct DOB on the applicable forms also.Hello everyone!
I am not sure, whether this question has been asked before or not - the search didn’t show any similar requests.
The problem is that I made a mistake in my daughter’s date of birth when submitting my DV lottery application last year. My application has actually won, but I’ve noticed daughter’s DOB is different when opening actual DS-260: the year of birth was different - 2023 instead of 2022.
I know it’s a very serious mistake and in most of the cases the whole application would be denied. Nevertheless I am interested to know if you can advice anything such as:
- contacting USCIS right now in order to help with a correction;
- thinking of appeal after submitting I-485
- preparing for a law suite (I have a mental health issue at the moment).
I am currently residing in the USA with my family having a legal L1 status, they are having L2.

p.s. post follow up questions on the 2024 AOS thread if you’re a 2024 selectee, or the 2025 AOS thread if you’re a 2025 selectee.
DS260 submission is not mandatory for AOS. It is required for CP.I appreciate your instant response!
And sorry for the wrong thread posting by the way.
However, just want to reconfirm or at least double-check on my understanding - is filing DS-260 mandatory in case I want to use AOS path and no to pass a consular interview abroad. I assume it’s not.
Thanks a lot!DS260 submission is not mandatory for AOS. It is required for CP.
Hi sir. Do you know if I have to put the receipt of the payment of 330$ to KCC in my AOS package ??thanks in advanceNothing has changed. This happens all the time. As a matter of fact, KCC actually tend to email asking for payment for the rest of the family/derivatives, before they will release the KCC file. A response explaining the rest of the family will be processing FTJ has always sufficed and led to the release of the KCC to the FO. This happens every year.
