DV 2022 AOS (Adjustment of Status) Only

So no problem if I sent a new application at the same time i sent an appeal right? Coz most probably it will be denied
 
@Sm1smom Sorry for asking this question again. I sent an Ombudsman request yesterday and also followed up with the congressman today but haven't heard back from them yet (I don't think they have any update for me). Since we are approaching to end of fiscal year, would be harmful if I mail directly to FO and asking for expediting the interview? If there is no harm should I explain based on the following reasons I am requesting to expediting the interview? (Also, attaching the reference)

1. Approaching to end of FY on September 30. Referring to early memo and USCIS website about deadline.
2. We might go running out of visa for DV cases and referring to the same situation in 2017.
 
Oh yea aware of this. As far as I can tell by the spreadsheet, nobody going through the Brooklyn FO has been issued a visa at all yet right?
I am also from Brooklyn FO, did my Bio on 6/28 and no response after that. I sent a congressional inquiry yesterday but doesn't seem promising.

Obviously it will take a couple of days (maybe weeks) to hear back from either the congressional or ombudsman inquiry - you can’t expect to hear back from them in a day or two. And I already addressed the directly mailing the FO question - yes you may, as previously stated: “This is a shot in the dark of course, no guarantee it will be delivered to the IO assigned to your case or it will be acted upon”.
 
I am quite certain neither Simon nor Susie mentioned visas could be pre-allocated to AOSers this year, you probably misread what they wrote.
I think what the poster meant was visas being fully preallocated to CP and none being left for AOS.

Yes, Susie you are right. That exactly what I meant because later in the post that Mom quoted I am saying that visas are not pre-allocated for us unlike for folks abroad. And as you also mentioned I didn't say that you said it would happen but only that it looks like there is a possibility. Nobody knows what will happen so I would never say that you or Simon made such a loud announcement :) You only give us some guidance during this journey. We can only just wait because not everything depends on us

I called the USCIS phone number today. After 40 minutes of being on the line, the representative told me there is nothing she can do to expedite the process and gave me the phone number of the DOS. It looked like she wasn't even familiar with DV cases as she kept typing and finding information online that I already knew better, for example, she asked me if I have checked the dvprogram.state.gov website, although I told her I have already attended the interview for my DV lottery case...:oops:
I also called Senator Booker's office about my inquiry but they told me they review emails in the priority they receive, so I should wait for at least two weeks. Considering the wait time, do you think I should initiate an inquiry with senator Menendez too?
What really hits me hard is that the USCIS officer that interviewed me told me she had to check with the DOS to see if there is any visa left, whereas a friend of mine from the same country as me had his interview the week after in another FO, and his case was approved right away.

No, the congressman's office told me don't initiate two senator inquiries to the USCIS because this would cause a delay in our AOS cases. We can only stick with one Senator. Since you've already initiated with Booker's office, stick with Booker's office and try to call them (2 phone numbers) at a different time because a different person might pick up the phone.

I'm still waiting for the updates from the Senator's office and tier 2 agent...

Just a wild guess, can your FO just be accumulating cases and then approving those based on CN? Almost 300 days of waiting is wild!

Yes Brooklyn FO tends to accumulate and process at the end of the year. This is normal for Brooklyn unfortunately. Its just strange they havent actually approved any Visas as of yet.

I requested a call from USCIS and today I got a call, which was marked as Scam Likely based Los Angeles, but I decided to answear because I heard that sometimes important calls got marked as a Scam. So it was the officer, she asked about my medical examination, it is the only thing I did not send and she told me if I can send the scan of the my medical examination on email. Her email is ********@uscis.dhs.gov. The only thing which confused me is that she called me from different number, not the one USCIS officer told me and she didn't asked me for the code. I just want to make sure that it is not scam and I can send my information. She also told me that I do not need an interview.

Hi, how do you request a call from USCIS? I tried doing that through Emma yesterday and the live agent refused and said my reason is not enough.
 
@Dr.Mikeleecooper I honestly think that this is the issue of the Newark office, even in the spreadsheet most people get their decision within a week or two after the interview, and in the Newark office one has to wait for a couple of months. The thing is that it's okay to wait a few months when it's March but it's not okay when it's mid-August. I think they'll have to expedite it at some point.

I don't think there is harm in contacting another representative.
When you called USCIS, have you asked them to escalate you to Tier 2 officer?
No, I did not talk to a Tier 2 officer. Based on one of the posts here, it may take up to 30 days to receive a call from a Tier 2 officer.
I asked her to submit a case expedite request, and I think she was even persuaded to do so but when she asked me about the reason, I told her that it is near the end of the fiscal year and if my case is not adjudicated, I will lose my status, then she was not convinced.

Finally a great update from someone in LA. I also tried calling like you but it didn’t go through. I think your case filed back in April. So, that’s why the officer called you. Did she ask why you want to get a tier 2 call? Hope you get your green card soon.

I was wondering if the call @litnastia got was related to the Tier 2 agent request to callback or if its a coincidence that the IO called?
