EB2 Processing

There are no approvals seen in EB2 section for 140. Have they stopped EB2 processing ?:confused:
 
EB3-CP peding from May03

Hi,

First off, thanks for all posts. Being going thru them all and it has been big help.

My i-140 details are

RD - May 14th 2003
EB3 - CP

Using the spreadsheet scanner for May 14th, I found 6+ cases that are still pending any action.

On Jan23rd report of processing times, for Eb3 it was reported as May26 03. Feb 20th report says the same May26th

Appreciate any suggestions on what I do next?

Call National Service Center myself or ask attorneys to check?

Is it because of CP?

EB2 processing

Nelabor,
From my experience with USCIS and I am pretty sure others too will agree with me, they will do things on an ad-hoc basis.
You can never tell when they will process what category.
The numbers on a lottery ticket are more predictable with USCIS !!!

EB2 processing has more work than EB3 and as per my knowledge, EB2 cases will go to different Officers, who handles only EB2 cases. I guess, they are still busy in processing the final batch of H1B cases (which were filed just before Feb 17, 2004). Hopefully we are going to see some EB2 Approvals from Next week.
 
AC-21 without AP

My 140 possibly gets approved this week.All my cases 1-140,i131,1-765 have rd of AUG' 11th 2003.I got my EAD in SEPt'03 but I didn't get my AP yet.Another thing to be noted is my wife got her AP in Sept'03 and I didn't get it yet.


I am desperate to leave the present company.
My question is Is it safe to leave the present company without AP approval?

and Are there anybody who has kind of similar case where EAD got approved within 2months and didnt get AP even after 6 months.Is this something to be worried about.when I call the UCIS 1-800 number they say that this kind of case is taking anywhere between 480 and 500 days.

My present H1 is getting expired by March end.

For using AC-21, I-140 approval is very important. AP is not. You don't have to worry about AP. Wait till I-140 approval and go ahead.

EB-2/CP/July 16..

No RESPONSE..NO RFE..NOT YET APPROVED...

I am seeing OCT approvals but NSC is officially processing April-02-2003 cases. So I cannot call and ask..

EAD Approved on Oct 3rd.
AP,I-140 Pending.
 
naanshi, if according to you the offficers handling H1-B cases have gone back to handling I-140 cases now, will the delay start again when the new set of H1 applications start in april (for oct quota) ?

jaba,dbsraju..what advice exactly ru talking about regd jaba's 140 approval..is it file it as EB3 rather than EB2?

As for as I know, you may file your H1B petition in April for next Fiscal year. But they will start processing only after October 01, 2004. So we won't see any delay in April.

Now, if my H-1 status expires and if I still haven't received my EAD approval, do I have to leave the country or can I still stay since our EAD application is in process?

----- You will apply derivative I-485 and EAD is based on your derivative pending I-485

Now, if my H-1 status expires and if I still haven't received my EAD approval, do I have to leave the country or can I still stay since our EAD application is in process?

----- if your H1 expires and you have filed I-485 and got I-485 pending receipt then no need to leave your Status will be AOS pending, EAD is only for work , you need EAD in hand to continue working or your H1 extension should be filed before H1 expires if you want to maintain H1 status.

** If your spouse I-140 is approved then you are safe to use EAD if I-140 of your spouse is Not approved then he should maintain H1 status till I-140 gets approved and should not use EAD because if he uses EAD he will not be on H1 status but if you as spouse use EAD it will have no affect on his H1 status, once you use EAD you need AP filed and approved IN US before your trip out of US
