Did you try contacting Senator/Congressman or liason through AILA etc? You should have been approved loong time ago. I'm surprised you let it slip for so long and now you are delayed!
If there were too many EB2s filed before yours, and the visa numbers for EB2 are over, then it could retrogress. I dont think it will happen.. Hopefully not!
My friend is in similar situation. (Has 2 MS in US) His attorney told that his company needs to pay X dollars when he gets his GC if applied in EB2. Since that amount was about 25 K more than his current salary, he applied in EB3 in April 03 and before it went to Regional Labor it was...
thanks Tammy. Since I'm on H1, do I apply for a transfer to new company and along with that can I also request 8th yr H1? Or does it need to be done in separate steps?
I'm with my current company A (GC sponsor) on my 7th year H1 which is valid till Oct 2005. My 140 was approved last month and > 180 days since I filed 485.
Can I move to another company by filing ONE application for H1 transfer and also for the 8th year?
Or should I first transfer H1 to...

Thanks rak1974. If I switch Employers and work with the primary vendor of my client instead of my company I can make about 20% more. But with my India trip next month, I woudlnt want any NOID or RFE on my 485 which jeopardizes my entry. I'm on 7th yr H1 but do not have H1 stamp. SO planning to...
I suggest you talk to your local congressman about your 485 approval. They are processing case as of Jul 1 2003. Since yours is before that, pinging USCIS through your local congressman will result in a quick approval.
One of the criteria used for local transfer is when the candidate hasnt worked for the sponsoring employer while in the US. Nothing ti fear though. You should be fine.
I too am in the same boat. I plan to invoke AC21 after my vacation to India. I'm planning to ask my prospective company (the one I'm currently working on a subcontract with my company) to give a letter offering salary similar to the one in labor but actual wages will be much higher. Can anyone...
