July PD report is out - Bad news

I am bit confused..

If they need visa # only at the time of approval of I 485, then why dont they let the applicant file their application

OR

if they need the visa# only at the time of filling a I 485, then why dont they approve the pending cases of I -485.

How can non-availablility of visa can affect both scenarios..

There are too many pending appllications. They don't want to accept an application and keep it in storage for 3-4 years before visa numbers become available. The ulterior motive it not issue green card for every one who came here on h1, this way some frustated people will go back, they get replaced by fresh H1 workers who are cheaper than premanent residents.

I was under the impression that the fact that your 485 application is accepted means that there is a visa number available and associated to the application.

so, PD should play some role here right?
 
I guess, I have to wait another 6 months

I am going for fingerprinting this week. I was hoping to get something in next 3 months. But looks like I have to wait for another 6 months before anything comes up. I don't think PD is going to make any difference for me.

Did you try contacting Senator/Congressman or liason through AILA etc? You should have been approved loong time ago. I'm surprised you let it slip for so long and now you are delayed!

If your case is EB3, your visa won't be issued after July 1st (till Oct 1st).

If you are lucky, then things might move and shake in the next 15 days !
 
I talked to my lawyer earlier & he said, Lets finish your second fingerprint & also he wanted to wait till my 485 RD becomes current.

I think its my fault. I should have contacted senator rather then calling attorney.

Well. Dont fret.. You are just 3months from seeing your 485 approval. You can enjoy the summer instead of checking mails/emails/USCIS website etc. Now go out and enjoy the summer. ;)

I really didn't check status until last month. Well another 3 months & then processing might resume on my case & then who knows how long its going to take.

Anyways thanks & now time to enjoy summer ;)

Called 1-800 number just to check whats going on & officer replied your Application is under review. what does it mean? is my case stuck in something or they are just waiting?

Most likely its got caught up in "Name Check"
 
what do yuo mean by name check? I had my second fingerprinting today. the online message says we received FPs & processing has been resumes. this message is from last 1 year that is after my first finger printing. Still yuo think my case might have stuck in name check?
 
The name check process is separate from fingerprints and can negatively affect the processing of your 485.

Although by "under review" could also mean "under review by an adjudicating officer", in that case you'd hear something within 30 days - except that as you know, EB-3 will be retrogressed worldwide in 2 weeks for 3 months.
