hi guys,

I got RFE today mail today. I don't know the details of the RFE.
here is the online message:

On June 6, 2005, we mailed a notice requesting additional evidence or
information in this case. The notice explains in detail what additional
material is needed. If you have questions about the notice, what is
required, or if 14 days have passed and you have not received the notice,
please call the National Customer Service Center at (800) 375-5283.


Not sure, can I call NSC to get the RFE details or my lawyer?
how long will it take for the lawyer to receive the details. Will they send a copy to us also?

They (USCIS) wont tell you over the phone. You got to wait for about 3-5 days before you can ask you attorney.

My RFE date is June 3rd and still my lawyer didn't recd it. I enquired with my
lawyer and she said that she'll inform me when she receive it. Please update your status once you know the details.

Hi rpv123,

Only today I received the details of my RFE from my lawyer. ABILITY TO PAY
the mentioned wages. They requested the coy's financial statements,tax returns and my W2 and salary statements. My employer is saying this is not
big issue. But I don't know the company's actual financial position.
I have to be patient.

Thanks for the update. Did you also receive a copy of RFE or just
your lawyer received?

Is there are a difference betn labor salary and yr actual salary?
If you actual salary is more than labor salary then you should not
have any problems.

I received the details from lawyer and the RFE copy in e-mail from my employer. Actually I expected this RFE as my salary for the year 2003 is very less than the labour salary (because of perdium). 2004 is better and now from Jan'05 I am getting GC Labour pay. Still I am worried and praying for the best.
 
My lawyer is still waiting to receive exp.letter evaluation from 3rd party.The due date is 14 th July.I am hoping that they will reply next week.
I got question on EAD renewal.My wife EAD is going to expire on Sep 05 so we applied for renewal.Do you guys see any delay in EAD renewal while we have RFE on 140.
 
hi Poobala,
I received the RFE details from my lawyer today. It is about "Ability to Pay".
Lawyer has asked me to send 2004 W2, 2004 tax returns and recent pay slips. She also has asked the company to send bank statement, tax returns and financial statements.
Labor PD - Oct 2003.
In 2003 - i have a difference of $5k.
In 2004 - i got paid labor salary.
In 2005 - getting labor salary.

Should the company send the financial statements for 2003, 2004 and 2005?
For 2005 what kind of statements are reqd, because the year is in progress,
i am not sure what will be reqd?
Will INS see the proof till year end of 2004 or will they see till date(June 2005)?
Keeping my fingers crossed.

Maybe you could provide your check stubs for 2005 to prove that so far you are getting paid the proffered wage?
