The Employment Third and Third Other Worker categories have reached their annual limits and no further FY-2005 allocations are possible for the period July through September. With the start of the new fiscal year in October, numbers will once again become available in these categories. It is not possible to make any estimates regarding potential cut-off dates at this time.
 
When 2006 FY Starts, All Perm approvals for EB2 and back log applicants(Eb2 and EB3) will be coming and EB2 gets cut off, and EB3.....its like a thing, which u can tell u'r grand children....like a story... Once upon a time, there was a category EB3........................................................ :mad:

I will visit this site and contact my attorney only in 2020 to find if they have any updates(Like LUDS).

The part that really sucks is ... at the point of Labor application, I already had my MS + 4 years of experience and yet I am in this EB-3 mess :mad:

My friend is in similar situation. (Has 2 MS in US) His attorney told that his company needs to pay X dollars when he gets his GC if applied in EB2. Since that amount was about 25 K more than his current salary, he applied in EB3 in April 03 and before it went to Regional Labor it was transferred to BEC Philly. Looks like it will be at least 2007 before his labor is approved.. Poor guy. Good you cleared your labor..

My EAD will expire on OCT and now i'm working by EAD not with H1. And i sent AC21 also. I have to RENEW MY EAD. Can i do that ??

Yes renew you EAD and AP regularly.
 
Though this EB3 is ugly now, it has actually less pain on EB3 guys since 80% I-485 EB3er are already dead with infinite FBI name checking. What's the difference they shot you once or twice when you’re dead? You're dead meat anyway in next 3~6 months. So, face it; be happy! :mad: :( :confused: :eek: :D
 
I am done with this whole retrogression thing. I lost hopes of getting my I-485 cleared with in the next 3-4 yrs. Well I guess we have to wait for decades. USCIS really sucks and it is waste of time and energy following these visa bulletins. This is really outrageous. :mad: :(
 
I was waiting it to move just two days because my priority date is June-03-2002, What really sucks is I have to wait three months to move three days. The whole systems is a mess and I don't know how this PERM thing is going to line up the things.

My PD is July 10th 2001.I chose Consular Processing and my case is in the Mumbai Consulate since May 20th 2005.In a reply to my mail they said that they will be able to give me an interview in July end/August first week.

So will my case also be on hold till Oct or they might give me an interview

Dont let this mess with your life

As long as 140 is approved and it is more than 180 days since 485 ND, use AC21 and carry on with your life. I believe AC21 is our only saviour at this moment.

F. VISA AVAILABILITY BASED ON THE “RECAPTURE” OF EMPLOYMENT-BASED NUMBERS

Title V, Section 502 of the REAL ID Act of 2005 (Division B of Pub. L. 109-13 enacted May 11, 2005) provides for the recapture of 50,000 Employment-based immigrant visa numbers that were unused in fiscal years 2001 through 2004. Such numbers are to be made available to Employment-based immigrants described in the Department of Labor's Schedule A and their accompanying spouses and children. The immigrant classification for these 50,000 visa numbers has been designated as Schedule A Worker with the category symbol being “EX”. Beginning immediately, “EX” visa numbers may be allocated to Schedule A immigrants and their dependents only; all other immigrants within the Third preference will continue to use the traditional Third preference classification. Note that any Schedule A applicant will first be eligible for a visa number under the traditional Third preference cut-off date. “EX” visa numbers may be allocated to all Third preference Schedule A applicants from all countries, including China, India, and Philippines, only if their priority date is beyond the established Third preference cut-off date or if the Third preference category is “Unavailable”. The “EX” category is CURRENT, and will remain Current for the foreseeable future

Why don't they use 'EX' visa numbers first so we can have some visa numbers for normal EB3 people.
 
I wonder whether the spouse's I485 is counted against the visa quota. Put it in other words, in case of service center approving the primary and his/her spouse concurrently or separately, I would like to know whether ONE or TWO visa is used in this scenario.

it is interesting to know whether approving a family contributes to the fast dry-up of the visa number.
 
Dependent approval

Can anybody answer this? If primary is already approved, will dependent come under this EB3 quota? If the dependent case is not approved by end of this month, will they have to wait until Oct-05?

No. Dependent is already filed 485 along with primary.

Case: Primary's 485 already approved and dependent's 485 still not approved.

In this case, if the dependent case is not approved by end of this month, will they have to wait until Oct-05 or will they come under different quota?

dates apply only for primary. if primary is good to go then dep should be fine.
