My approved I-140/AP got a LUD on July 28 (last Sat.) as well. I wonder how many people got LUD on that day? Everyone? or the applicants filed I-485 around June, July last year?

I applied in Feb 07 and also had LUD on 7/30 & 7/31. I am not sure if they mean anything or was it a system glitch!
 
I do use EAD as my company's policy (read saving money) was not to renew H1 when an empoyee has EAD.

Generally it is safer to have cover H1B as on rejection of 485 your status is immediatley ( and some say from the date you left H1B umbrella) illegal.

It's up to you about the level of safety you want. I had no choice about that and in retrospect I think it is useless to feed USCIS even more money as my personal decision is to quit US if 485 is denied.

So think over and decide how much safety you want and how dear is staying in U.S for you.

well said, add to that that I have already started my 6th year, so I won't be able to renew my H1B anyway if my 485 was denied right?, see, screwed both ways.
Also, my attorney charge $2500 to file a new H1B (he said there is nothing as transfering H1B), add to it the "educational" fee (????) and other fees, total is over $5000. it might worth it if the new H1B was good for 3 more years

OK, now if this makes those of you who are on EAD feel better, listen to my thing. I never had H-1 Visa. I went on Adjustment of Status directly from F-1. I did not have the opportunity to get an H-1. I have been pending for almost a year now.

If you are sure that your 485 application is solid, go for EAD. Many of us should be sure about this after reading this forum and others for so long. Therefore, if you know that your application has even a little chance of denial, forget about EAD and renew your H-1 even if you have to pay a hefty price for it. This is of course if you definitely like to stay in this country.

I should also say this: you won't probably sleep well when you are on EAD even if you are sure about your application. That is at least the state that I have many times :). Therefore, assess your situation and your emotions carefully and then decide. Besides that, think long term, is paying $5000 now going to affect your life so much in the next 20 years? It is most definitely not convenient to pay hard earned money for these things but I don't know if there is a better and safer way to go.

I've used my H1-B for 8 years (extended a couple times due to changing jobs, stuck in the Backlog center...) I did not sleep well before started using my EAD. I'm kind of regret about that I decided to stay in the US and work for the past 9 years. Now with three kids and my career built up here, it's going to be hard for me to make a decision to give up the life here and go back. Giving up my H-1B, for some reason, give me a lot of relief. Don't ask me why because I don't know. I guess when there's no choices for me to choose, I can't help to start looking some other parts in my life that I seldom look at. Bottom line is, if my I-485 gets denied, I do not intend to spend any other nonsense time on filing never ending petition on H1B, F1, L1....what so ever that going to make not sleeping well in the next 10 years. Just my 2 cents.
 
Did you happened to see an LUD for EAD/AP?

I am also waiting for my 2nd EAD approval, but this time it is taking longer than the last time. Did you get any LUD before the approval of your EAD/AP?

today i got my 2nd EAD approval email and 485 lud
i think they dont want to approve my 485 that's why they approved my EAD renewal

Had a LUD yesterday (after talking with TSC IO) and today ( took infopass and spoke to IO, he showed me the screen where its still shows my Namecheck is pending since aug 11,2006)

dont know what's happening:confused: :confused: :confused:
 
Two quick questions. 1. During your infopass, did the IO mention when you shall need to do the second fingerprint? 2. Did the IO mention it's absolute impossible to get a I-485 approval before October simply because they have exhausted the VISA numbers this year? Many thinks for shedding some light.

1. No, I applied 485 in July 2006, so FP is good until Jan 2008
2. i didnt ask him about visa numbers as i went to local sub office they dont know other information, if i ask other than my status they'll tell me to call TSC people

Went to local office for infopass.. Namecheck pending

Just be honest, tell them this is taking too long and you are anxious to resolve this and get on with your life. They are human beings too, they should understand.

Not much useful. Immigration officer says. .My namecheck is pending at FBI since 2005. They can not issue any VISA until they receive Namecheck clearence. He checked to see my wife's case and said .. Her name check is cleared. and waiting on mine. Dont know what to do here. No outlook date. :( Any suggessions?

You are right, if there is no choice, you should not kill yourself. But those folks who have a choice can decide.

Do you remember what the screen looked like, and what part says "name check pending"?
 
i think its cobol/mainframe system
in the top my name and my src information was there
in the bottow..there was FBI Namce Check Status : Pending

FBI Date receipeved : Aug 11,2006

its a simple screen which has this information
but IO looked in other screens also and told me everything is okay for you except Naecheck clerance,once it cleares you can get approval anytime

i said this is same from last year, he replied yes, but you have to wait....

I did ask these two questions.

1. I asked IO that.. My FP is done 2 years back and it is due now. He said.. If they we need FP our system will send you notification. We dont initiate here.
2. He said ..They have to seen name check clearence before talking anything about visa availability. or approval.

Another point which someone informed me about H1B. At least H1b status is known in some banks/financial institutes. If you are on EAD :
a) it is a one year valid period
b) Not many institutes are aware of EAD. They ask :
... You are on H1 ? No
.... You are Permanent Resident : No I am on EAD
... What's that ? It is the in between thing

So being in no man's land was never beneficial. Add to that need for Annual Parole. Expenses add up if you have family.

Regarding expenses of H1, check if you can file yourself. My guess is there are do it yourself kit available for H1b. Don't know what they do about LCA.

485 finally approved

I received the cards in the mail last week after 6 long years. Went through 3 EAD's, 3 AP's and 2 FP's. I am glad it's finally over.

Not sure what's going on, but there were LUDs today on my I-140 and I-131 case. I tend to get a lot of weekend LUDs - does anyone else have this issue? Anyway, I hope the LUD on my I-140 implies that my lawyer sent the response to the RFE and that it will be approved soon.

I also got a response to the SR I had generated on my I-485 at the time when USCIS moved all the I-485 processing dates to March 2007 for a day. It said that the processing on my case has been delayed due to "additional review". Does anyone know what this means? I've been told my namecheck is clear but that there are other security checks pending on my case - is this what "additional review" refers to?

I too had an LUD on my 2nd i-131 today. It has been pending for almost 6 months!

As for "additional review", I received this response to every SR I generated in 2006 (i-140, EAD1, AP1). All these petitions took unusually long time to approve in 2006 for me and everytime I inquired, USCIS responded with "additional review". My guess is that "additional review" refers to the USCIS' internal checks and mechanisms that we would all love to learn about.
 
Well as per the advise given by some of the folks here i took an infopass on Friday and i explained my issue (Please see below). The immigration officer was very helpful and he did issue a new Fingerprint notice (Code 3) for the same day. He also issued a Fingerprint notice for my wife.

Now what??????? Will they do another name check???????? or should i wait for ever again? Any thoughts? Thanks in advance.

Folks i need your input on this. My Case is EB3 (PD 06/2003). I-485 transferred from VSC to TSC 03/2007. LU changed on 07/03/2007 & 07/04/2007. I called TSC using POJ method. The Customer rep said that my Fingerprint have expired. I received this weird Fingerprint notice on 07/28/2007 (which looks like a xeroz copy) from TSC mailed on 07/25/2007. In the fingerprint notice i have been asked to goto Application Support Center in Boston on 05/15/2007. You read it correctly it is May 15th 2007. I am not sure how to go back in time to make this appointment. Do they (TSC) have invented a time machine? I am really annoyed. Any advice? Thanks in advance.
