Labor Date: March 8, 2004
Labor Approved: November 27, 2006

I-140 (EB-2) Premium and Concurrently Filed I-485 at Texas Service Center

Filing Date: January 26, 2007

I-140 Approved: February 8, 2007

Fingerprint Date: February 14, 2007

LUD: February 15, 2007

I-485 (Approved?????): March 23, 2007

While My Spouse's I-485 got an RFE: March 23, 2007!!!!

I guess in the premium process they approve the case with only FP checks, nothing else. Demo, it`s so quick!?

REceived USCIS letter, what does it mean

I applied labor certificate in Sept 2002, and filed 485 on Aug 2006. I had two finger prints taken last Oct and Dec for I-485.

My case is at TSC, so I called them to check the status since they are processing cases for sept 2006 already. USCIS sent me a letter as follows:

we are actively processing this case. However, we have to preform additional review on this case and this has caused a longer processing time. if you don't receive a decesion or other notice of action from us within 6 months of this letter, please call customer service at teh number provided below.

What does this letter mean? are they performing background check?

Hi,

Our fingerprinting (Self and Spouse) appointment was on 3/19/07. After the fingerprinting the LUD changed (I485) for me but not for my spouse, is this normal?

I believe this is a generic response from USCIS. I received the same response from USCIS on 3 different occasions: inquiring about my i-140 last year, inquiring about EAD, and inquiring about i-485. Unfortunately, this response does not tell you much.
 
More LUDs. no real update

Latest LUDs noticed today.

myself LUD 3/24/2007 no change in real status.
wife : LUD 3/24/2007 -
child: LUD 03/26/2007 -

I donot know what is a happening, may be I could be extra lucky to get approval in this wave of LUDs (which I doubt).

Today, visited ASC to get Biometrics done fror my child ( 2 hour ago). I saw LUD March 23, 2007 for me, wife, child. However, no real update.. same status.

I am surprised, LUD happened yesterday ( 3/23/2007), whereas I just had biometrics done for my child today(03/24/2007).

I was hoping that some positive outcome might happen, but I didnot see any such information so far. , I have to just wait..........

Which one is worse: Name check or security check?

AP document
My wife's AP document is returned undelivered. Even the filing receipt is not delievered to the lawyer it seems. But the lawyer has sent me the case number. Somehow the lawyer is not very helpful as the company has hired the lawyer and not me. Please tell me if my wife is required to be present to receive the AP document. She will be returning back to India after the finger printing this week. I am planing to change the address to my home address.

If your wife intends to use the AP to re-enter the US, then she needs to be present in the US to receive it first (just in case the immigration officer may notice the discrepancy in the dates when she re-enters).

OK, thanks. Other than that, will the postman deliver the document to the address? I mean does he need a signature for receipt?

This reminded me of when I received that same canned response to a telephone inquiry. I immediately came to these boards and elsewhere posted a "rant" message, which I've copied and pasted here, rather than linking. Anyway, my 485 was 4 months out of processing time when I wrote that, so I was pretty frustrated. The case ended up getting approved a couple of weeks after that, so just be patient.

When you're one month beyond processing time, call the 800 number. They'll say: "hmm.. you're right. Let me place an inquiry". Then, in one month's time you'll receive a written response to the inquiry saying "we're actively processing this case. Please inquire again in six months from the date of this letter if you don't hear from us". When you wait these extra six months and start reaching your one year anniversary of filing your 485 you start doing things that make you feel like you're doing something but actually are totally irrelevant and yield ZERO results:

1. Make infopass appointment, you're told: stuck in namecheck
2. Call FBI fingerprint unit, they'll say: "Yeah, you're prints were cleared the same day and we sent that back to USCIS"
3. Email FBI name check people to check on status, they'll never reply.
4. Seek help from senator/congressperson: After a month they'll reply: "You're stuck in FBI namecheck... nothing more we can do"
5. Visit this forum daily, put your info on trackitt.com, check your online status daily
6. Your anxiety levels increase, your productivity at work decreases, you consider other crazy choices like switching to consular processing, filing lawsuits, etc.
7. next thing you know, like most other people it will be 2 - 3 years until your approval regardless of what you do.


Am I too cynical...? What do others think? Isn't it really that way?

I called USCIS today and the lady asked me if I got my interview notice. I told I did not get any notices from USCIS, so she was going to request the notice to be resend.
Want questions do they ask in these interviews?
What are the documents we need to take?
Any help would be appreciated.

Hi,
I got a letter from USCIS today, in reply to my inquiry from a month ago. The letter states that Permanent Resident Card was mailed on Dec 01 2006, however the post office returned it. Now they are going to send the card to the address of this letter. Does this mean that my GC is approved? I do not have any LUD since Nov 03 2006 nor did I get any approval notice by mail. All my EAD, AP and finger print notice did come to my present address.

I contacted USCIS for status. Today received the letter from them saying there is no visa number available for me. But I am under EB1 category. I have both EB1A and NIW I-140 approved. Stupid USCIS.

The status on the Website is still "Case received and pending". I have not moved recently or changed address. The only thing I can think of is that the A# used on my 485 application matches the EAD card (Practical training) I had received after my schooling from INS (Dallas) 10 years ago. I am guessing they might have mailed the card to that address?

AP question
Is it true that if the AP is approved while applicant is outside US (departed before approval, but on valid H4), the application is considered abandoned. That is what is mentioned in I131 form. Please let me know if anybody has this kind of experience.
