TRACKER: NSC I-140 in Spreadsheet

My case is not transferred to anywhere. I was just trying to know what is the mechanism of 485 between the service center to the local office.

I was looking at the 485 processing dates at the local (district) offices, and they seem pretty fast. So I wish to know if there is any chance that some of the 485 get transferred to the district office and under what circumstances.

unbelievable variancies of all these cases...even feb 04 approvals! i just feel bad for the guys who are waiting for a year

Waiting for more than 1 1/2 years ?

You're deserved to get your quicker I140 approval since you have been waiting more than 1 1/2 years for your LC.

I don't know about others, but my entire LC took less than 4 months, and filed concurrent I140/I485 during Sep, and waiting for my I140 approval.

Does it mean that USCIS processing according to the priority date of LC ? Not I140 priority date ?.

Any comments ?

lc, you are lucky in the sense that the labor depends on which state you are working in..each state has different processing times..for me(in michigan),its been over a year - labor not cleared..but its not as bad as compared to my friends in NJ where it takes more than 2 years! : )

I had stopped expecting any date or time by which I would get any of my approvals. I had checked the government website a few days ago (maybe a couple of weeks?) and just forgotten about the whole thing. Then one fine morning, I had an email from my lawyers.

I am thinking that the I 140 part would be processed in the order the application for i 140 was received.

But my case is EB2 RIR CP while yours is AOS. Dont know if that makes a difference. Maybe some experts can throw some light on this.

Well. Here is my theory on 140 processing within NSC.

I think all the cases processed by CIS are done in a layered manner. Every case is progressively checked to see if it meets the specified requirements. And the requirements increase in complexity as the application crosses each level.

For example, after the initial screening, the first layer might be investigating if the applicant has worked in one company. If yes, the case is approved. If not, additional documents need to be checked to ensure that the applicant has maintained a valid status between jobs. I believe this task is spawned off to another officer.

For example, the first layer could be asking a series of questions like - Is the sponsor a financially stable company, Has the application not switched jobs, Does the applicant meet the job requirements etc and etc. If the application passes this test, it is immediately approved.

In the second layer, any question in the previous layer that did not have a clear-cut answer is then investigated in detail. If information is missing, an RFE is issued. If the required information is present, the case is either approved, or depending on the requirements of this layer, sent to the next layer.

Now my hypothesis is that different sets of officers perform activities in each of this layer. Pure Adam Smith. If you closely watch the approval patterns, it appears as though that each of this layer slowly travels forward. So for example, the first layer could now be processing cases in Feb second week, the second layer in January first week, and so on. And I believe there is a layer where NSC has decided is the one where the cases have either been approved, or are hopelessly complicated. And this layer should be corresponding to the date published as the 'Current Processing Date' at their website.

And I do think that your case backs up this theory, because all of my friends who have worked in the same company all their time here, have got their 140 approved in less than a month. Of course, there might be exceptions. But I haven't seen any yet.

Remember, this is just a theory. Then again, it is possible that the cases are picked from a pile exactly like the Super Lotto.

One basic flaw in your theory. The person being sponsored does not need to work for sponsoring employer. (GC is always for Future Employment).

Secondly a specific case is assigned & gets attached to one specific officer & normally is not transferred from one officer to other.

At I140 I believe BCIS performs 2-3 tests:

1. Co's ability to pay
2. Future Employee's Qualifications & Experience should match as documented in approved labor
3. Possible Frauds

I140 logic

logic of jaika, sanshriv appears to be the rule they follow at ins.

they process cases in passes

first pass they check all , any applications which is not complicated is passed, so you will see march , feb, jan approvals but very few (straight forward cases ) , everything matching.

2nd pass are the ones which need more time to decide.

and so on till it comes to the last pass, the difficult ones which are handled by experts (lawyer like officers).

so your wait will depend on the level of your file.

just like we solve problems in our exams, first solve the easy ones, then the hard ones you solve it later, or just dont solve it at all..

Process

I totally disagree with the last posting. I have an US Degree and I am getting 65k+. My lawyer applied in EB3 Concurrent AOS.

My understanding is that it depends on the catagory. One of my colleagues who applied april 03 in non concurrent catagory was cleared after 8 months(dec,03). At that time concurrent had the priority. I have another friend who applied same time but concurrent case cleared in one months.

Both of them did not get any REF.

It seems to me NSC has started processing concurrent cases.
