and i am trying to figure out, if this is approval message or just a notice message..

Ability to pay issues scenario

--------------------------------------------------------------------------------

Here is my scenario, EB3 labor certification priority date is april,30,2001 Labor certification Aproval December 23,2005, I-140 receipt letter february 15th., aditional info required march 20, 2006. Preferred Wage is 42,000.00., my company close the fiscal year in june 30. This are only near the realistics is only to do my math based exactly on that, any ideas, they requested aditional info, wich says they need the 2001 and 2002 w2's but nothing about my company, they only requested 2003,2004, 2005 for the company
here is my history of w-2's
2001-10,712
2002-17,090
2003 -40,800
2004- 39,520
2005- 39,520

Here is the company 1120's clossing every 30th. of june
year net income liability net asset accumulated dep.
2001 3,656.00 146,154.00 146,154 23,294.00
2002 5,189.00 1 40.745.00 140,745 32,908.00
2003 6,031.00 141,267.00 141,267 45,601.00
2004 11,963.00 192,686.00 192,686 70950.00
2005 23,466.00 , total currnt asst 85,325.87 ,total fixed asst 122,827.29, total current liabilities 3,876, long term liabilities 151,260.70
total liabilities 155,137.41. Based on this does anyone knows what are my chances to get approved my I-140 or denial. Thank you all
I FORGATT TO ADD THIS, in 2001, the line of paid wages said 64,900.00 probably more o less but for few dollars, i went to my lawyer and i explain all my concerns, and she says there is nothing to worry about that everything looks good even when 2001 was low income but high enough in wages to pay the privileage wage, she also show me the letter where they were requesting 1120's of 2001-2002 to see ability to pay, plus my w'2, and they are asking again for the job letter offer whe re edited to resend it since we already send it but more detailed we re doit, plus they were asking still for more evidence of experience so i had to go to my old companys to get letter explaining my position. i hope some one can claryfy this, as the one that post before, my company is growing and growing every year and is making enough to pay my privaleage, and also she told me that they want to make sure there is enough money at the time they see the I-140 there is where they really check if there is the salary paid or enough to pay. Thank you if someone can clarify more than this, by now i will take my lawyer advice to feel peace and sleep good. :(

Your I140 IMMIGRANT PETITION FOR ALIEN WORKER was received on April 4, 2006. We mailed you a receipt with information about processing. It is taking between 400 and 450 days for us to process this kind of case. We will mail you a decision as soon as processing is complete.

I see lot of guys in this forum getting approvals pretty quickly, not sure why I got a message stating 400-450 days, did anyone else get like this, whats the deal . . . can someone throw some light . . . .

Yes. It does not take that much time, but that is the standard message. In fact after the center consolidation, I have seen things speed up a bit. I just got my FP notice, whihc i felt was fairly quick.

Greetings everyone,

I have just received my I-140 receipt notice.

Please add my info to the tracker

Case type - I-140 / case number starts with SRC
Received date - april 10, 2006
notice date - april 12, 2006

originally filed in Nebraska, but they apparently transfered it to Texas.

priority date - 11/2005
EB3 worldwide
I-485 was not filed because of retrogression

I am hoping I-140 will be approved before my 7th year h1 runs out so that i can get the magic 3 years extension... but after seeing the online message that it takes 400+ days to get it approved I see I will shell more $$$$ for h1/h4 8th yr extension and God knows how many years more after that..

Company's lawyer is nicely benefiting from USCIS mess

Approval time for I-140

Don't worry felix31. That is the standard message that the receipts generate. If you can check on the web page they(TSC) are processing I-140 with ND of January 17, 2006. My I140 got approved in 25 days and had the same message, some people even got approval in 10 days or so. Yours should be approved in 3 months or so. :) :)

thanks andy,

that is encouraging...

the sad part is that after I-140 stage is done, no one can proceed to I-485 stage...
I shouldnt be complaining so much as poor souls in BEC are forever stuck with much earlier PDs than mine.
It's just that after 6 yrs on h1, working now for GC employer, everything looks scary, uncertain and so ........ kind of useless.

who knows how many will reach I-485 step. At this point I pray that my job lasts forever or at least for the next 5-6 years, till I enter I-485 and fulfil reqs for AC-21...

Man.....the whole system sucks
