Thanks for your comments..Both the lawyers (my company & Client's) have advised me to go for another extension and not to work on EAD just in case if I-140 get denied...in that case I will be out of status...

But in my case I have to leave my employer with in 30 days...and I can not use AC21 to switch job as I-140 is not approved yet. Now we have been hearing about I-140 will not be approved till I-485 is ready for approval so AC-21 does not hold good....

I have no option other than going for extension and hope there are no RFEs for 140/485...
 
EAD/H1B Extension

I asked my lawyer about getting H1B extension even though EAD is approved due to some posts I read that USCIS will deny and not send RFE anymore, which will make me out of status. His answer is not to do H1B extension because this is a hot topic now and will be addressed in AILA meeting next week, chances are they will still do RFEs. He said to wait what will come out of this meeting and I haev 15 days to respond to RFE in which time they can file for an H1b extension. Thoughts anyone?

You have the precedents. Your friend was able to successfully switch the jobs. You know that AC-21 cant be used. If the sponsoring company continues to sponsor for the GC which is really for the future job I dont think there is an issue but it would help if you get help of some VERY qualified lawyer in this regard.

Folks,
I just finished up with the excruciating LC process from Atlanta and I am all ready to join all you folks on the next leg of the crazy journey. Just yesterday I finished signing all the forms for concurrent filing.

Although I finalized all documents for 140, 485 and EAD I did not fill anything for AP. Is this something that I have to take up with the Lawyer right away before he sends the docs in to Texas INS?

Also, I plan to send in the medical check up and vaccination requirements required for I-485 later on (in about a month or so). Is that OK or should I spend some more time and get all of the doc go in one package. Are there advantages/disdvantages?

RFE rec on wifes AP

Guys,

Just wanted to let you know that I received an email today regarding additional information being requested from BCIS for the I-131 (AP) application for my wife. ND on the AP is 03/25. My AP application has not been touched yet.

I will update all on what the RFE is about. Hopefully its some small thing that can be resolved quickly.

Got emails today regarding I-765 that they requires additional evidence, called the number they did not give any information about addtional evidence. can anyone tell me is there any way i can get the information about the evidence requiremnets before getting the receipt.

I wonder when you applied AP for your wife, did you include a copy of your marriage certificate? My wife's AP was also RFE, and after providing a copy of our marriage certificate, it was approved within days.
 
Basic question about I140/485

My I140/485 have been filed with TSC two weeks ago. What exactly do I need to request from my immigration specialist, so that I can check my case status online ? I have seen people talking about case number and receipt number. My immigration specialist doesn't know anything except to just handle the communication between me and the lawyer.

Hi,

Get the photo copies of

1) All the USCIS forms the specialist has mailed to USCIS
2) All the letters and cover letters, and
3) All the receipts from USCIS (yes, this is very important)

In this way, you can always go through the documents at your convenience.
 
AP approved

All,

My AP got approved today. My wifes AP got an RFE. They have lost a couple of pages from her form. My lawyer has resent the entire application. Her AP should be approved shortly.

simultaneous adjudicating 140/485

Glad to find you guys in this forum, even recognizing some old names.

Does anyone know of this new procedural changes for adjudicating 140/485 altogether for cases filed after 4/30/2004? You can find this memo details under murthy.com under New Procedures for Concurrently Filed I-140/I-485 Cases Posted Apr 23, 2004. Sorry I did not keep the link.

My question is whether TXS is implementing this new procedure? If so, there is a risk for not able to use AC21 since 140 will not be approved before 485. Currently 140 is taking about 1 year, so one can be completely safe after 140 approval of 1 year. If the new process takes longer than 1 yr to adjudicate 140/485 altogether, then there is no safety time any more, correct?

Can someone add my case status in the spreadsheet?
