As far as I know, only after I140 is approved, and I485 passed 180 days, u can find another job using AC21. In this case, u are always in legal status, doesn't matter if u have a EAD or not, and can apply EAD at anytime. I140 approval is the key. It is just my 2 c.

FYI : I see my AP(I131) case number LastUpdateDate as today (05/26/04), but there is no change in STATUS. I am anxiously waiting to get my EAD approved.

I think TSC is working for EAD

I applied EAD Renewal on March 25th 2004 and got it approved in May 24 and I received cards on May 25th, in one day I got it.I surprised. I-140/I-485 concurrent filing RD is 04/02/03 no result yet. I don't know what to say TSC is working or not. no use of EAD without I-140 approval.

I140/I485 concurrent filing and change of employer

Hi,
I have asked my current employer to file these concurrently.
I also have an employment opportunity with another company.
How long do I have to wait with my current employer before I make the switch?
Or can I make the switch right away and continue the I140/I485 processing with the new employer?

You have to wait till both these conditions are true:
140 is approved
485 is pending for 180 days

If you can convince ur. current employer to process ur. GC as a future employer, u can change jobs right now using H1. However this path to GC is fraught with risks so pick urs.

Do you have any news for your case? Your case is Concurrent filing, According the Foji Memo, I140 and I485 will be approved at the same time.
Have you done your FP anbd Name check? Are you in TSC Center?

Your RD cannot be Mar 10,2004. It must be Mar 05,2004 based on your receipt number.

SRC - TSC
04 - 2004
107 - Mar 05

So your receipt number for I140 will also be SRC041075xxxx. There is no real way of relating these numbers from one petition/application to another petition/application.

Question : How many days it took for you to get your EAD card in your mailbox from the day it was approved (online status)?
 
I am just wondering if anyone sent "TSC Expedite Request Form" to the director of TSC? If so, what was the reason that ONE could provide?

Hi All,
I recently cleared my labor and am deciding about how to go about the next time.
My company says it does not do concurrent processing. So it will apply for I-140 first. My questions are below...

1. Given the current situation is concurrent filing better than filing I-140 first?

2. What is the current processing time for I140 in TX? Which month are they doing right now and how is it moving along?

3. My requirement is to get the EAD ASAP because my wife needs it. Which route should I go to accomplish this? Concurrent or go with I140 first?

Any help would be appreciated

Based on the USCIS memos and discussions here, it seems concurrent filing is better than standalone 140. USCIS want's to discourage standalone 140s, this is what attorney murthy also thinks. But we do not have any evidence yet to show that this indeed is true so I don't think anyone can give you teh exact answer to this.

Concurrent filing has other benefits which are unrelated to current situation though.


2. What is the current processing time for I140 in TX? Which month are they doing right now and how is it moving along?

They are processing April 30th 2003 cases as per the last update from USCIS. Based on last 2 updates, it looks like they are moving about a month in 12 actual days so do ur. calculation.

For EAD ASAP, you will have to file 485 which means concurrent filing. Filing 140 alone will not get you or ur. wife EAD.

Change of employer after 180 days - (140 not approved)

Hi,
I've filed I-140/I-485 on 01/15/04. Got EAD and AP first week of March 2004. My 7th year H1-B extension is expiring on 07/04/04 and because of some reasons I have to join my client. My client has agreed to file 8th year extension and my employer has no problem in continue GC process.

1) Can I join client on H1-B?
2) What will happen to GC process? As per "immigration-law.com" if you loose the job than this will be a potential denial of GC. Is changing job or losing job are same?
3) Client's lawyer are advising me to join the company after 07/15/04 i.e after 180 days of RD. To use AC-21 do we have to have I-140 approved?

I will really appreciate any reponse.

My 2 Cents:
I dont think the 8th year extension you are referring to can be considered since you will be joining a new employer and the GC is sponsored by old employer.
AC-21 can be used only after I-140 is cleared and the TSC has clearly noted it. Previously there was some confusion but now thats not an option.
You need to try something else. I am kinda in the similar situation and I would like to join the client asap but waiting for I-140. Sorry to give you bad news but as they say forewarned is forearmed.. All the best.
 
Change of Employer

I am sorry for confusion. Actually my compnay is processing the 8th yr extension and once extension is approved than clinet will tranfer the H1-B. I do not know if this makes difference or not....

Just to give you an example...colleague of mine did exactly the same..now he is working in CA...on 7th year extension for his client...Only difference in his case is ..he is still waiting for Labor approval...Our company gave a letter to his lawyers that they are willing to continue the GC and will offer him a job after GC approval....

Lemme know your thoughts..

If you have your EAD and AP approved, why would you even need to renew your H1-B?
EAD (Employment Authorisation Document) gives you the permission to work and AP gives you permission to travel...
So, why would you need to renew your H1-B and spend all this money for nothing?
