AutoRemanded case still in EDD

My case was auto remanded on 7/1/03, but it was still in EDD.

I checked some cases close to mine, some are also still remanded (case number before 09532000).

But there are recalled cases after that, my lawyer just told me the process in DOL is inconsistent.

I really hope they haven't forgotten those remanded cases.

My case was filed with BS+2yrs, so it should get recalled...

You should push your HR to retest the market. I don't think there will be too many resumes. From my experience, we ran a one day ad in the San Jose Mercury News and got only one resume with no match to our requirements. If we get only one resume for a BS+0 exp. requirement, I'm sure you will have better luck.

If you pay close attention to the ads in the news paper, you will see that most of them only provide fax numbers to submit resume. I hope your HR and lawyer are competent enough to run the ad and get a favorable outcome.

Also, is it true that all resumes recieved must be forwarded to the DOL.

Hello All,

Any clue as to what happened to all the auto remanded cases.
My case details is as follows:

EB2
Received at DOL : 05/14/2002
Remanded to State: 03/23/2003


The AVM still says " Remanded to State".
No clue to what's happening to my case.Wondering if there are folks here who are in the same boat.

If these two dates are the same, then DOL has obviously not updated their database. This would be cause of concern.

If they are different, and the status date is close to when your lawyer replied to the NOF, then DOL has updated your case with the wrong status.

In either case, try to get your lawyer to speak to someone at DOL to follow-up on your case.

I have a couple of May-June cases (one with NOF) in my company. I'll post any updates.

The last case status update date is the same as the RD. Like you said, this is something need to be worried about. I'll talk to my lawyer tomorrow.

However, I also doubt about the reliablity of the information that we can get thru AVM. Are those information up-to-date? Or to what extent can we rely on that information? According to my lawyer, there're only 2-4 officers in that regional office handling our cases. If that is true, actually they're not doing a bad job considering the huge volumn of cases. They might just have no time to keep the AVM information up-to-date for every cases.

Just trying to find excuses for them ;)

We just ran the ad last week and currently passing the two weeks waiting period. I will post updates after we submit docs to DOL and receive their decision.

I wanted to get some info with regard to market retest.

a> is there a particular day of the week on which the retest should run ?

b> i understand it is in the mercury news. - how much does it approximately cost to post an ad ?

- No. Any day of the week is fine.

- Depends on the size of the ad. Mine was a small one and it cost us $606.

Hi All,
My case (BS+0 Exp) has been remanded in June'03. Since I have been working for my employer for about 4.5 years they are willing to relocate to one of our offices in Illinois or Minnesota, to help me refile the labor from one of these states.
As of now, there have been no petitions or applications filed from these states (IL, MN), looks like mine will be the first case. That being said, can I file under RIR from the above states (IL, MN)? Our lawyer says she cannot since there are'nt any previuos cases from that region.

I do have an offer from the IL area, just wondering what to do I am more inclined towards accepting the offer since the experience with my current employer would count.

Any advice, ideas? Thanks in advance.
 
Urgent question about job title

I have an urgent question:
I worked as consultant in the company, the company did not give me any detail information about my LC,even case number, but I have a copy of ETA750 A, B. In ETA 750A, my job title is "Consultant" in column 9, but I cannot find any job with title as "Consultant" from http://www.bls.gov/search/ooh.asp?ct=OOH, also I downloaded all my the company's LC cases from
http://www.flcdatacenter.com/casesearchperm.asp and found that my LC was filed as OCC code: 030.062
-010, job title is Software Engineer, my question is: which job title should I reference to? And when DOL open my case, which job title will be used and what job title will be shown in my LC approval notice, Consultant or Software Engineer?

The DOL job title is based on your job functions rather than your actual job title. Whatever title they choose to put does not matter as they will see if your experience etc. matches one in the ETA 750 filings.

Denied to Certified

Hey Guys,

Finally the patience payed off. Its certified. yuppeeee..
I guess mine was one of the oldest cases that was pending with DOL. Its such a big relief.. :)

My case details.
PD - 3 July 2001
RD - 11 March 2002
1st NOF - Jan 2003
2nd NOF - March 2003
Case denied - 25 July 2003
Reconsideration app.- Sep 2003
Case reopened - 24 Feb 2004
Certified - 28 Feb 2004

Big bay area comp
MS+ 0 years
DOt- 999-151-032

So it just took 4 days for them to certify it.. If they have to do it you hear yrom them within a week otherwise its stuck for years..

Any how.. I believe that now they have stared to certify more applications (as per my lawyer).

Hopefully all you guys would hear some positive news soon. Just hang in there.

team (well we are all waiting to achieve the same goal so I should consider all are part of one team)..

we used to have a excel worksheet or database for case status, since DOL is back to december 2002 lets build the database of cases of december 02 & onwards to keep track to DOL progress ( I mean atleast we have something to have a look at it rather then just waiting !)..

any feedback gurus ?
