I have a very specific question. Guys, please respond to this if you know the answer.

I got a 3-option letter after my application was "returned by the state after a remand". With the news that people are getting certified after retest, I am excited.

My case details are

DOL rd: 09/30/2002
Requirement: MS+0 (I have MS+6months before this job)
Company size: small (50+ people)
DOT code: 999.151 - 032

My company is ready to retest, however they are somewhat scared because of the following reasons. Please help me find out answers to these questions

1) If they do retest, and find qualified US workers, are they forced to hire them?
2) If they don't find qualified US workers, but if the application gets rejected, does that mean it will be sent back to SWA/EDD?
3) If it gets totally rejected, when can we refile the application?

>>Your company would have gone through the same risk when they did the ad before. Hence the risk is always there.
2) If they don't find qualified US workers, but if the application gets rejected, does that mean it will be sent back to SWA/EDD?
>> No it gets rejected
3) If it gets totally rejected, when can we refile the application?
>> after 6 months

Just US Citizens or Permanent Residents also?

Can we put this requirement in the ad?

If we cannot put this requirement in the ad, how can we reject any potential H1 applicant?

Sorry if these are stupid questions.
 
Qualified US worker means US Citizens & permanent residents.

I read somewhere that you can reject H1 applications for the purposes of labor test, but you need to document it. I haven't read the rule myself, but logically it makes sense. Talk to your attorney.

Regional Office receipt date - 11-31-2003


I am wondering how long would it take for me to get my LC?

Any feedbacks. I am new on the forum.

If you're employed in the tech-sector and have filed under RIR, then atleast one more year before DOL even looks at your application based upon current processing speeds.

If you're in a circus, then 15 days. I'm not joking - they're processing non-tech applications way faster than applications for tech jobs.

Company is in Bay Area, no remand or query.

Processing time

The processing of the labor applications has advanced few days finally after a long hault of four months. Looks DOL is now processing November 25th after they were stuck on November 22.

I'm new to this thread. Just adding my info for tracking purposes:
My LC was received by the SFO DOL on Feb. 28, 2003. Of course, I'm still waiting and hoping to hear people with Dec/Jan/Feb receipt dates getting approved.

DOL - Attorney Correspondence

Any idea on how long it takes for DOL to send correspondence to the attorney after certifying a case. The AVM says my case was certified on Feb 25th but my attorney hasn't received any news yet.
 
UNIVERSITY LABOR

I work for a very reputed University in California as Senior Software Developer. They filed my Labor in July ,2003.

Could anybody please let me know the prospects?

Will they be any advantage if the emplpoyer is a University?

I really appreciate if anybody could answer my question.
