The assessment notice was regarding the hiring practices at my company. The lawyer(s) provided another advertisement to show that my process of hiring was consistent with the normal method the company follows.
The education and experience specified are MS+1-2 years.

this is the list of the 051 cases. it's very dispointed that seems like they're still stuck in cases before 2/11/2003. Or, there have been so many 3-o letters.

Any insider's idea?

Or the 60 day re-test bounce-back cases have started flooding their desks so they cannot process anything new again.

LC pending and gets laid off- Urgent

Hi,

Could anyone tell me how long a person can stay in the country if he/she gets laid off when he/she is on H1-B Visa. Is it possible to stay in the country based on "LC is pending"?

Appreciate your answer

you can stay in the country as long as your visa is vaild on your passport
thr is no law as such 2 weeks /1 month or whatever .....but you need a fresh h1-b as soon as possible
pending LC is no reason

No, once you got laid off, even if your H1 status/visa is not expired, you are out of status immediately. USCIS usually tolerates 2 weeks gap between two H1B. But this gap might be a trouble in I-485 phase. Pending LC is useless.

Sorry to say that. Everybody hates this policy.

did any body read 2 wk gap on uscis website ??
out of status means, you are no more on h1-b, but you are still legal in US as long as your visa is vaild

You lose status right away and have to start preparing to leave the US immediately. However, as far as I know there is no law about how long this preperation can take you. So, you should be able to show that you started preparing to leave (trying to sell car, house etc).

I agree with GCIsTortoise and FiveMileTom on this one. As soon as you are laid off you are out-of-status and the immigration office will "allow" a 2 week maximum stay. If you stay longer, it might cause a problem for your next re-entry. A pending LC has no relevance to your status and it is for the company and not for you personally.
As for the visa, you are no longer employed at the company which sponsored your visa, in which case the visa is invalid too. So using the visa is not allowed either. The company is obligated to report the visa status of an H1-B employee if he/she is laid off within a certain stipulated time. No one knows how long that time is, which is the source of all the confusion.

Under immigration law, the concept of a visa is distinct from the concept of status, even though in discussions the word "visa" and the word "status" are often used interchangeably. The word "visa" in immigration law refers to the visa stamp issued by the U.S. consulate in the foreign country to enable a person to board a flight to the U.S. On the other hand, a person is given "status" at the U.S. Port of Entry, by the INS officer.

For example, the U.S. Consulate in Chennai, while issuing a non-immigrant visa (tourist, business, student, etc.) does not guarantee the applicant the right to enter the United States. The visa should be viewed as permission to travel to the U.S. to request the Immigration Officer (at the Port of Entry) for permission to enter the United States. The document that indicates what a person's status is, and how long s/he is allowed to stay, is the Form I-94 (Arrival / Departure Record) that gets stapled to the passport at the port of entry. This card indicates the status and the expiration date.

Looks like AVM is back up today. I finally found my case showing up in the AVM, after exactly 7 months

Looks like every aspect of DOL is speeding up unless the case has "California" in it :(

DOT Code for Software Engineer

Hi guys,
AVM says my DOT code as 030.062-010
Any of you heard this DOT code?
Since I am software engineer, it should be well known 999.151-032.
More over when I checked SOC codes, there is nothing starting with 030.

Any idea Gurus?

California DOL uses SOC codes as DOT codes by just putting 999 in front of SOC code...

for example SOC code for Electronics Engineers (Except Computer) is
17-2072 ,,, the DOT code for the same Job Category is 999.172-072

11-0000 to 55-0000 are 23 major groups of Job Category.. you can click on the group of your interest (say 17-0000) to find further details & codes in that group

I guess DOL is not updating AVM currently ( It doesn't mean they stopped processing - I hope so !), lets see if they update by Monday. They ware not updating Seattle cases also, last night they updated one case "Certified on Aug 30"...wait & watch.

Regarding, BRC.. thats Ridiculous, if they are starting with PHL not CA...PHL RIR current dates are 08/03 (6 months ahead of CA).

You guys think we should send letters to DOL / Senators / Congressmen like other regions are doing ??
 
GP and Buddha, I second your thoughts - of sending letters to DOL/Senators/Congressmen and the Minister of DOL, etc. - anyone who may help.

I've been waiting this thing for over two years, and still don't know how much more time it's going to take. That's no fair, while we make so much contribution to the country by paying taxes and supporting the IT industry.

I hope you guys as leaders can do something for all of us. Maybe we can bring Rajiv's attention too.
