Anyone still out there who is affected by employer remanded cases? Or there arent any...and that would make me the odd man out! Are there any updates at all?

Seems like people who filed their cases way way later than me are getting their labor certs approved!

I guess the best option is to leave the current workplace, find a new job and just file for a new labor app...at least that way there are no false promises of backlog reduction, PERM etc...

me too

nikedude,

i am there, dont worry and 99% of the H1-Bs from my company are also there with you. All employer remanded cases. When we point to the HR and lawyers, why they cant advertise and send the results back to dol, they said not their stupid policy. We cannot get green card here, we cannot leave the place, we dont have the courage(afraid if we can get the right job and money) to go back to India. dont worry there are thousands of people like you and me here.

hope this helps nikedude.

hi Sam, can you also email me information about those successful cases? My email address is hjsmile@yahoo.com. Thank you very much!

I just got that 3-option letter. MS + 0 year experience.

Need Your Help,

1. The chance of approval after re-testing market is very high (90% above).
2. Normally 2 week opening for respnding to the ad.
3. If DOL is not satified, you may receive second NOF, or denial, or remand to state.
Recently many received 3 option letter--NOF and the processing speed is slowing down due to the loss of some COs in S.F. DOL. I have collected some successful cases after NOF by re-testing the job market from this forum, if you're interested, I can post here or e-mail you (preferred since it has 5-6 pages long).

Can you post some details of your case? Did you get some RFE in the state level? Others?

If anyone has got the new approvals or got 3-option letter, please post here and exchange ideas?

Sam

Hi Sam,
Since, so many of us want this list you have collected -- can you post it to this forum as an attachment.

Thanks.

You are probably right ! BTW My company is still hoping for
PERM or Backlog reduction stuff to become a reality.

Some time back In_GC_Race posted "PERM Final Regulation Rulemaking Process in ZigZag". I don't think there were any updates to that from the
White house yet. Where is C.J. when we need her ?

We can do ? to make them reinstate the AVM ?

How can they just suddenly stop it ?

ZB
Has anyone tried calling AVM today?

I hope people who read this forum and are hearing of their cases are updating the forum about their cases. Even if - God forbitd - its not a good news for you, it will help everyone to know where SFDOL is in terms of the processing date.

Post your case

I second you since AVM is down for several days and nobody knows what is the processing date. If you get any news about your case no matter good or bad, please share your case information here to keep this decent forum active.

Thank you all!

At least a local immigration lawyer who got cases pending @ SFO DOL, should call and request them to reinstate AVM

Hi All,
I was informed by my employer that my LC was certified. :)

RD : Feb 25 2003
999.151.032
MS+1 Year

I thought the last approval I read on this forum was Feb 25th (MS+1 year). My RD is Feb 27th 2003. I haven't heard anything from my lawyer.
I will post as soon as I hear something.
A good weekend to everyone.

Last week I rec'd an email from my lawyer saying 'The state work force agency has requested some additional information regarding the application' they wouldn't tell me the details. I found out from my manager that state work force agency wants retest the market for my position. The lawyer is telling to my manager that even one day of retest market may be problematic. Now they are holding on my PR processing. I don't know what's that mean. What will happen if I chose to retest the market? Is any risk that I will lose my job if 'retest' got good responses? Can anyone give me some suggestions?
I'm with large company (with layoffs) in Bay Area.
LC filed date: 03/06/2002
DOL rec'd date: 02/28/2003
Looks like they have reached Feb. 28th.

Let us know!!!

Please let know how long would it take for us to get our LC???

Hi, Gurus,

I am a mathematician who works at a big university. My LC was received by DOL in Sept.,2003. So, it will be 6 months before they reach my case. However, my case was filed as MS+0 although I had MS+2 yrs of experience at the time. My H1-B will reach 6-yr limit in Jan, 2006. My question is:

Is it necessary to do something, eg., file another LC (non-RIR), before the end of 2004 in case DOL asks my employer to retest the market and then reject my case? Then, I can at least apply for the 7th year H1-B extension. Or am I worried too much?

As far as I knonw, there have been no many layoffs in my field.

Thank you.
