Guys,

I need some input urgently. My case was filed with no experience(BS+0 years). So, i got the 3 option letter. I did have 4 years of experience at the time of applying for the labor certification. But my HR and lawyers did not apply like that. Now, my HR is saying that if i send my experience letter for those 4 years, they can respond to the 3 option letter saying that i do have experience. Is it something DOL would consider?
I am confused. I cant get any more info from my HR because they are dumb. Can someone tell me once the labor is applied can we change the job requirement...

That's exactly what my lawyer told me too, he insisted on keeping the requirements for Bs+2 years else DOL will reject it on the basis of "too restrictive" requirements.

But, I fought against and made it BS + 5 years ( I had 7 years of exp. at that time)

My details are:
PD: 4/10/2002
DOL RD: 03/31/2003
DOT:999.151-032

Guys, any idea when my luck will shine ?
Are they still giving the 3 option letters by lottery ? :mad:

Do you know what was advertised ? I mean was was the experience requirement asked during rectuitment process ? If the position was advertised with BS+0, DOL will not consider your 4 years pf experience. The best answer to three option letter is RETEST THE MARKET.

What will be the response (from the candidate's side)for the "retest the market" option.
1)Can the ad be modified stating the reqd. exp needed is 3+ years( considering the fact that the first ad was placed 2.5 yrs ago ) .

2) If some candidate applies for this ad ,will the candidature of the present candidate gets cancelled automatically???

3)Do we need to respond to DOL saying that nobody responded to this ad....and DOL will certify the case???? or some other documentary evidences are required.

Any ideas/suggesstions/links will be of great help.

hi..gp111! just wanted to know whats your prediction/thoughts on my case no.#09542465
with dot code# 999.311-012 received @ 01/29/03 when is it to get certified...seems feb 2003 is getting certified..

*** No You cannot modify the advertisement, if you do, it will be considered a new LC application.

Many thanks for the reply.My case has a dol receipt date of 02/18/2003 and I am sure that I am going to receive the 3 options letter because the ad showed BS+ 2 yrs exp.
I believe my company/lawyer will not cover up any cases.What is the option I have other than filing LC afresh.

Why do you think you will get 3 Options ?? We have seen many approvals with even BS + 0 also. Company/Lawyer will not cover up any response but the lawyers are paid for getting your LC certified so atleast he will do his job justifying your application !!

Hi Gp111,
The reason Im thinking like this is because one of my colleague who had receipt date of Jan 15 th 2003 got the three option letter his was remande back to state(option chosen by company) and our ad, job profiles match.
Only difference is he did not get any query from the state level I got and it was promptly answered by our lawyers and it got certified through state labor

How do you know that there are only 75 cases pending in Feb? Do we know how many cases were received by DOL in FEB, MAR, APR (2003) etc?

there are appox. 75 case between feb 13 to feb 17

If my case number is not quoted in these mails, does it mean that it is most likely
remanded back to state or I probably got the 3-option letter etc? I am having
a hard time getting the status via AVM. My RD is 02/11/03 but my case number
is not one of the case numbers quoted in this thread.

No.. The Cases Numbers above are random checks, those are not the only cases approved. I have seen some cases are taking little bit longer then the others ( may be different officers !).. so just wait for few more days as you will get good news soon..
