Need help!

I'll be completing my 6 year on H1B in Nov'04 . My previous company has filed my LC in RIR case. My prority date is Nov'02. LC has been moved to fedrel in Sep'03.

My question is, Can I file for 7 year extension of H1 from my current company? My LC has been filed from previous company.

Yes you can always file H1 Extension from any company irrespective who has filed the Labor if LC is pending for a year or more (which is true in your case)

I knew I would be writing this someday, but the wait was almost unreal!!
Anyway, after spending weeks on that ONE day (Feb 10,2003) they have finally moved on. My LC was certified on 8/13, but since the AVM was not working yesterday, I got to know of it just this morning.

I have not posted many mesages but seems like I know a lot of you. GP111 special thanks for spending time & effort to keep this forum moving.

# You don't need LCA for Green Card, LCA is for H1B.

# If RD@ SF DOL Is Dec 2003, you may get your Labor Certification around August 2005, say if you move to MN & apply for LC next month you will get LC after 13 months (4 months MN SWA + 9 months Chicago DOL)... so basically you will get LC from there almost same time or later..

# I-140/485 almost same in all the regions or will be same by next year as USCIS is working towards it ( for example, CSC Pilot Project)

SO I would move to MN only if its gonna help me for carrer / future growth not for GC !

I have a masters degree, but the job description was bachelors+5 years. I think it will be EB3, I will have to talk to my lawyer about it. Ant ideas if I can qualify for EB2?

One thing I must say is that at the time of filing, my lawyer wanted the job description to be Bachelors+2 yrs. His argument was that this is a standard procedure. I insisted on making it 5 yrs as I had nearly 6 yrs of experience by then. I had to argue with him for about half an hour... in the end I think that saved me.

Lesson - guys go with your hunch. It just doesn't make sense to lower the requirements if you are more qualified!

Bachelors +5 years qualifys for EB2, go for it & you may get your GC in next few months.

Congrats. Btw, good advice - don't give in to what lawyer says unless you are conviced.

I guess by calling AVM. But don't do it everyday unless you are close, otherwise, we will jam or crash DOL AVM system. Somebody like GP111 call it regularly is good enough.

Finally !!!!

Great news...finally heard the sweet voice "Has Been Certified". This is my first post and have been passive reader of this forum all along.

I've one question though, my lawyer didn't inform me about the case number as it is against the employer policy, i've browsed the flcdatacenter and found the matching case under my employer. So, i'm not sure whether the case i'm looking at belongs to me.

When will my lawyer recieve the intimation from DOL?. any ideas?.

Is there any similar forum for concurrent I140/I485 for beginners.

That's exactly what my lawyer told me too, he insisted on keeping the requirements for Bs+2 years else DOL will reject it on the basis of "too restrictive" requirements.

But, I fought against and made it BS + 5 years ( I had 7 years of exp. at that time)

Labor Certified Finally!

Hi Everybody,

Finally heard the sweet news ringing on the AVM today, that my Labor has been Certified. :) Good news after 2.5 years of long wait!

i have been a passive reader of this forum and its the first time that i am posting the message.
