Processing time for green card based on asylum

Isn’t this long? I applied within a year with not sending my medicals. I was requested to send it last week. I am just waiting until the last day to send my medicals. Here is my timeline in 2024:

1/2 asylum granted
4/1 GV application with no medicals
9/3 medicals requested
12/3 I will send the medicals

My plan is to have one year from the grant of asylum in 2024 to the grant of GC in 2025
Isn't it that RFE must be responded to within a time limit, normally within 1 month? Make sure that you read the RFE letter carefully. By the way, didn't they ask you in the RFE for proof of 1-year residency?

Hi everyone!

Sharing my timeline:
August 24, 2024 New Card Is Being Produced

Yes they gave me 90 days. That’s why I will wait.

No they didn’t ask for one year residency. But I have been states for 8 years without leaving ythe country. I provided documents for that.

It's great that you have 90 days and that covers 1 year residency. But .. the only thing that matters is you reside in the US for at least one year AFTER you were granted asylum. I don't think it matters if you have been in here before that. It's good to know that they don't ask for that because that is the only thing I didn't include in my application.

I don't think USCIS sends an RFE for the 1-year physical presence requirement.

You are right. So Jan 2024 is the time of my granted asylum and I am trying to make my GC application be just after Jan 2025. I will send my medical exam on December and pray thar they will process it after Jan 2025

When did you applied your I-485? Immediately after grant asylum or waited few months?

What happens if USCIS will process GC application before 1 year passed since asylum approval? Will they deny application and time and money will be lost or USCIS will request RFE for 1 year rule? Or they will just wait for 1 year before processing?

I found this link with clarification from 08/26/2024

If you have any experience or can ask your lawyer it will be appreciated to get clear and correct information

It is basically saying that you can apply immediately after being granted asylum and they will not deny your application if they get to your appliation before a year; however, if they start your case before a year, they might ask for proof or residence in the US which may lengthen your case.

As for me, I asked my attorney and he told me to apply immediately after being granted asylum which I did. I have been reading this forum carefully. So far no one has been issued a GC before a year unless they asked for an expedite.

Thank you for your answer. The only question is what will happen if USCIS asks for proof of residence after 6 months and gives only 90 days to answer? According to paper of RFE application can be denied if no answer within 90 days period and you will have proof of 1 year residence only after 180 days in this case.
I saw here that one member of this forum got RFE for Medicals (I693) on 09/03 just after 5 months after he applied for GC on 04/01 and 8 months after asylum granted on 01/02

I see what you mean now! Being in that situation could be scary... I hope they are merely asking this person to submit all documents before they start working on his file.

Thinking aloud and only speculating, a lot of us submit both i693 and i485 at the same time. Has anyone who filed both at the same time received an RFE request? Could it be that something like this could potentially happen to those who don't file medicals right from the start? Again, I am only thinking aloud!

I would like to ask everyone, I was granted asylum on 08/2024. Can I apply for 485 immediately? If the 485 is reviewed within one year of actual residence, will it cause the 485 application to be delayed indefinitely? In addition, can the 485 application be submitted in the same package as the RTD application? Thank you

People are divided over whether you should apply immediately after or wait, so just read the posts before yours in this thread.

About applying for RTD and GC at the same time, I can share with you my attorney's advice and he is a very good attorney. He told me to apply for my GC first, and wait to get the receipt before applying for RTD ,which is what I did.
