Also, any of you all by any chance thinking of AC21 ? Would you share

Hello All,

I have a quick question, Are LUD seen on check status page or do I need a customer account on uscis to get emails about that.

I have not seen any update after fp on i-485 status (has the same info as before fp, it takes between 800-900 days to process this kind of application...).

Further, any body knows if name checks are initiated right after fp or how are they done?

Issue with EB3 & EB2

Hello,
I have a question for you. I know I am doomed with my EB3 PD May 2001 and having I-140 approved.May be waiting time of 3 to 5 years. I have BS in computer science and 11 years of IT experience. Is it possible for my employer to file PERM under EB2 and transfer the PD date.I asked my company Law firm and they say not possible. Your thoughts please......

Here is latest update on my case..

It was an RFE about legal status.

"On February 16, 2006, we received your response to our request for evidence or information. It is taking between 850 and 900 days for us to process this kind of case. However because preliminary processing was complete, the remaining processing time will be less than the maximum stated in this message. You will receive a written decision on this case."

if it is eb3,this is not possible, however, , but you can always try a new one under eb2, and yet it is never late.
 
Just saw this thread and want to submit our details. My husband's employer applied for I140/I485 concurrently in August 2005.


EB1 Multinational Manager TSC Concurrent
140 RD 08/01/05, I485 RD 08/22/05
EAD, AP RD 08/22/05
EAD, AP received 9/22/05
140 RFE dated 8/27/05
RFE Response RD 10/25/05
I-140 Approval email date 10/28/05
FP for self and spouse done 11/02/05.
I485 LUD on self and spouse 11/03/2005.
No LUD for 7 year old daughter's I485.

Going by the June Visa Bulletin we will be current again on 06/01/2006.
Let's see what happens then. :cool:
 
My case is transferred to TSC from CSC.

1. Tried the trick to reach TSC but since my receipt starting with WAC, it always directed to CSC, anyone know how to reach a TSC rep using WAC receipt ?

2. I have a pending 485 with NIW 140 , another 140 is approved. Will they link my 485 based on approved 140 automatically ?

I think it may be possible, unless refilling for the same job with the same employer somehow negates the ealier I140. Also, you must get the language on the Labour Cert just right. For EB2 with 11 years experience it should say something like "Job requires Masters degree plus 2 years of experience, or a batchelors degree plus 7 years of equivalent experience." There is a USCIS memo giving examples, and if the _job_ requirements state "Advanced degree or batchelors plus equivalent progressive experience", then EB2 should be fine. If the job does not mention advanced degree then it may still be possible to do EB2, but you have to really study the memo hard to conclude this, a cursory glance would imply EB2 would not work.

To use an earlier priority date the earlier case must be in the same broad category, ie employment for employment or family for family. So EB3 for EB2 is OK because it is employment for employment. What you can't do is employment for family for example.

A priority date is not transferable to another
