I need Help Please , They Lost some of Documents @ Interview

I get it. If they lose your entire A-file I don't know what they can do. Even if they lose their own documents, like approval notices or let's say an entire N-400 application. I'm pretty sure that even in that case they cannot approve things blindly, they would either have to redo the missing parts of the record or they'll just hide their head in the sand and ignore the problem. You've got a point, I am not sure what the procedure is. If you find a memo or field guide that would be great.

Some part is not even redo-able. If they lose teh key information
about how you got the GC in the first place, how can they make that
part up? There are only three choices for them
(1) They have to think you got the GC correctly and approve your N400
(2) They don't recognize you have a GC and insiste you just clam to be a PR and deport you
(3) They have to acknoelege you are a PR but they can not approve your N-400

In case situations 2 or 3 arise, you file a WOM and let the court take care of USCIS. In any case, I highly doubt that the USCIS will try to refute a LPR's claims that his/her GC is legitimate.

Hope this is extreme unlikely and never happen to anyone. Does USCIS only keep one set of hardcopy of Afile or make several copies and even scan them
into E-files?

The odds that entire file is lost is slim, but the chance of USCIS losing a few file may be not that small and I think that is relevent to the OP's case.

From what I've read, the USCIS is currently implementing methods to fully digitize their records. I'm sure that prior to this, backups of physical A-files were stored on microfilm, or other antiquated storage methods. Considering the importance of documents that are contained within a typical A-file, it would be utterly stupid and irresponsible not to make backup copies.

On a different note, I'd love to witness the USCIS explain in front of a judge that they are refusing to recognize someone's LPR status due to the fact that they lost that person's A-file and cannot corroborate the fact that their status is official.

The same thing can happen to citizenship status. that is why
Many suggest good care of certificate of naturalization like
deposit it into a security box of a bank etc because of the risk
that you lose it and USCIS also lose track of your citizenship

Great link, and I stand corrected on not adjudicating if documents or A-file are missing. I knew about the T-file, but didn't connect the dots.
 
OK , I got some answer today.

I called CS and asked them to transfer me to an IO or 2nd level Cs rep . Man i tell you , they transferred me to the nicest , most helpful IO officer i ever talked to ( a lady) and this is what she told me :

You have past your citizenship test , congrats ,

the officer have not made a decision on your case b/c some files are missing , officer already requested those files.

give us more time , USCIS has 120 days from date of your interview to make decision.

If we don't need any other documents from you, the next letter you receive will be the letter for your oath.

call us back in a month and ask to be transferred to IO to follow up.


she was super nice and helpful, i just don't understand why the IO who interviewed me couldn't tell me these stuff. Now i just have to wait.

I don't mean to dampen your enthusiasm but she just sugar-coated the same message for you. The only thing you learnt is that you may have to wait for upto 120 days. Do you know what is "the missing file"? I do hope you get your interview soon.

This is the scenario I have guessed (see post # 33). Of course like what BrokenArrow suggested, it is not
that certain yet but I believe second interview is not really necessary.
 
I atleast know what the hell is going on now. I already ask my congress man to get involved.

BTW , wen can i start send my complaint to Ombudsman ?

Maybe you can make an infopass to go to your DO in, say, 2 weeks.
I think you are fine. What the lady told you is very specicific so I don't think
it is juts sugar-coating. the only problem is when they can get your "missing "
file. It takes some time. They don't do that by catching day and hour
because it is not their personal matter.

Infomass uusually can appint a date that is only one day after but
In case, there is no slot for an infopass appointment, You can make an infopass today but for the date that is 2 weeks away. You can cancel
it if you don't want to go or do not need to go anymore (I think even
if you do not cancel no one care).

I meant to say "get your OATH soon".
 
Did you signed part 13 of application? (I am talking about where officer signes next to yours)If you have signed part 13 of application, oath might be the next step.
If IO has not ask you to do so that day then USCIS might set up another interview for you even if just for signing that section.
Hopefully that is not the case.
