I need Help Please , They Lost some of Documents @ Interview

I am going to write letter to NBC and Baltimore office and ask them what documents are missing and if i can provide it to them again . I will update this post as soon as i get any result.

Don't waste your time and NBC and Baltimore office personnel. It doesn't look like they have lost your documents or that some documents were missing. Otherwise the IO would have asked you for them. Most likely your A-file didn't arrive in time. Nothing your letter will do about it.
 
There is no interview done so that this 120-day rule is not applicable.
The OP was interviewed for 45 minutes. So the 120-day rule applies here. The fact that the interview wasn't finished doesn't matter, as the interview had started and it was USCIS decision to end it before asking more questions or seeing the mystery document which got lost by USCIS. If the document was so important, they should have waited to find the document before scheduling the interview, or rescheduled the interview without commencing it.
 
By the way, did the OP waited 45 minutes for the interview to start, or did the interview go for 45 minutes? It seems a rather long interview if it lasted 45 minutes.

NO , first he asked me 5 test questions , asked me to right Alaska is the greatest state , then he started looking at my file and his computer and he left me in the roon for 25 minutes without telling me what the hell is going on , then he came back and said there are some files missing , they forgot to send them , i asked him the nebreska office ? he said yes, but i think he had no clue and that's scary to me.I asked him exactly what files are missing since i had copy of all documents with me , and he just said some files.

Yes i was in the room for 45 minuets total , he asked me 5 test questions , asked me to read couple of sentences and asked me to write Alaska is the greatest state. after that he told me he needs some documents that are missing. :mad:

What is a file and who keeps it ( Nebraska since my status was asylum ? ) ? also do you have any idea how long it takes till i get the IL again ?

I don't know if this will help but some folks are saying that their FOIA report doesn't contain all their file like application for RTD or EAD or AR-11 and other documents. is it posible that interviewer computer indicating all the mentioned application and they were not in the file? Don't you think this might be the case?
Apparently by saying some documents are missing, he had your A file but some doc were not in it and perhaps he could see note or something about them in the computer.

A-file == Alien File. It contains your applications for permanent residence and your naturalization application and other documents pertaining to those applications, like photos, birth certificates, etcetera. I think these are usually kept in the national records center. My guess is that when you send the N-400 application the service center requests your A-file from national records center. When your interview is going to be scheduled the service center sends the A-file to the local office.

Because your interview was going along fine I doubt the entire A-file was missing. It might have been some other document, name check results? Fingerprint results? You can try to schedule an Infopass and try to talk with the IO supervisor (I'm not sure if you'll succeed) and tell the supervisor what happened at the interview and that you don't know which document is missing and that it is a matter of great concern to you. I agree with Jackolantern that as you were interviewed you might benefit from the 120 days limit to get a response or you can sue. Anyway, I wouldn't write letters because I doubt it's going to help. I would either wait or schedule an Infopass as I mentioned.

You are right , I saw my binder or A file and that was pretty thick, but again he didn't tell me what was missing. Thanks for your help.

In that case, maybe you already actually did your interview. But
are you sure the IO asked you 5 test questions? 6 questions with correct answer are needed. Did you get the interview results letter?

No , he didn't give me anything , but he said next time you don't need to take this test again , i put the result in your folder.

I am not sure if you need a second interview or not. Maybe the next thing
you get is just the oath letter. Because if you do not have anything that
complicate yoiru case, then the interviews should just go over your N400,
civic test questions, Reading and writing English sentences so that your interview
seem to alreay have all thesse covered. If the USCIS miss some files, they
should find them and make a decision without a need for another interview.
The files they miss are not files you need to provide with yoru current N400.
So if they locate these file, they should have eveything to make a approval
decision without a face to face interview.

I am positive your a-file was there, if it was not then he won’t even start your interview. It will be something to do with name check or some documents are needed form other agencies to confirm the info/documents that you submitted.

You could see I waited for over 3 months. Hope you do not wait that long.

When did you get rescheduling letter after your got descheduling letter? and are descheduling letter and rescheudling letter from
NBC or local DO?

If the USCIS indeed permanently lose some files, will USCIS just have to assume there is nothing negative in those lost file and approve the case?

No matter what if the USCIS lose something, it is their fault.

No way. If they lose some document and they need it to approve your case they will ask for it again. If you made the big mistake of sending an irreplaceable original document then you would be out of luck. That's why one always sends copies to USCIS, whatever you send them it will become part of your record so be mindful of what you send. It doesn't matter if it is USCIS fault or not, unfortunately it doesn't work that way.

This only applies to documents on your part. But if USCIS lose
their file they created themseves, then how can they ask you to
provide it? For example, you cna only send in your I485, and
some portions are for USCIS to fill like decisions. If they lost
this I485, you can not provided it. and no one keep all those
past files for himself
