I need Help Please , They Lost some of Documents @ Interview

No , i didn't sign anything.

and what about Part 14?

Part 13 and Part 14 are mandatory. You almost certain need a second interview for Part 13 and Part 14. I don't think they can let you sign
Part 13 and Part 14 right before the oath.

I thought so, I totally forgot about part 14. Now atleast you know that there will be another interview but the main question is how long will it take.

I don't know if this email mean any thing or not , I got it yesterday :

Application Type: N400 , APPLICATION FOR NATURALIZATION

Current Status: This case has been sent for a standard interview.

Your case has been transferred to a local office and an interview will be scheduled. As part of our standard processing you will be sent a notice when the interview is scheduled, or if the office needs something from you.

do you guys think this is for my 2nd interview ?

Many other folks have got same email yesterday even those who have completed their interview succesfully and waiting for the oath letter or one of them says that his file was transfered to local on March and some never had their case shown online or on Phone automatic system and has filed on 2006 or some has dissappeared as soon as the file was reaching local office.
I am assuming that USCIS is trying to make all the information and movement of the case available on their check status system for applicants and their status won't disappear on status check after A file transfers to local office and lift the phone call pressure to their 800 number.
If you have noticed the email they are sending out does not indicate or specify anything about the time file was transfered so it coveres alot of applicant in diffrent time frame and anytime in the past to date and as usual USCIS mess up many cases when try to correct something and in this one is just misinformation.I hope we can check status online all the way to the oath now. I don't think this email mean anything on your case and it has happened in wrong time of your immigtration journey.

I got pretty much same message from my congressman office today . they talked to Baltimore office and uscis told them at the time of interview Preliminary checks had not been completed.they are reviewing your case and they will send you a letter.

So i guess i just have to wait. This is so F***ed up.

Can some one please advise me.

My question is , if 120 days passed by and uscis don't take any action about my case , how can i file a complaint against them in the court ? do i have a right to do that?

From uscis site :

72.3 Decision Process. (f) Continuing an Application .(3) Notifying the Applicant of a Continuance .

USCIS has 120 days after the first interview to make a decision about the application.

Except in the cases where the applicant must be re-tested on English language and/or history and government (which must occur between 60 and 90 days after the initial interview), the second interview must take place within 120 days after the initial examination. [See 8 CFR 335.3(b), and 8 CFR 312.5.]

Thank you

I am on the same boat :(

All they did for me was sending a status update. I don't know if I will be denied or not. :(

But you have said that IO did not give you anything after interview. What will you submit on your lawsuit as a proof that interview has been done? Is it possible that IO intentionally did not give you anything to hang on to for decision covering his butt for the lawsuit?
The other question croosed my mind is that because you GC was through Asylum did you make any trip to COP and if yes, Isn't it possible that IO saw that in the computer. Just my thought.

From what I read, ARMIN has not completed the interview since the N400 has not been finalized and signed. It will be hard to challenge on the basis of 120 days of interview rule. Need to think of other kinds of challenges / pushes to get this file moving.

GODSON however should be able to challenge (after getting paperwork in order) because his interview is truly over (different thread but he posted heres, so...).

I still say file the 1447(b) anyway. USCIS will probably prefer to just call in armin78 to sign it and decide the case instead of explaining to the court that the files were lost and section 13 wasn't signed. Especially since it is USCIS fault that it wasn't signed.

I have called USCIS CS several times after my interview and talked to second level officers. Every time i called they told me that I have passed the test and the officer in charge asked for missing documents and USCIS have 120 days to make a decision. So their record shows i was there for initial interview and i passed the test. even last time i talked to them , about 2 weeks ago, the IO officer told me that i can file a lawsuit after 120 days. So USCIS record shows that i was in DO office for an interview.

Also , since couple if people here told me about signing part 13-14 , i asked them if i have to go for a second interview or not , and at least 3 of the IO told me that my next letter should be a oath letter not an interview letter.

I never went to my COP since i got to this country , so that is not an issue. I am pretty sure they didn't have my A file or part of it.My congress man office contacted uscis and uscis told them that "preliminary reviews has not been completed" , which it doesn't make sense ( then why the F*** did you schedule me for an interview ????)

Now , how can i file a lawsuit ? District court or federal ?

Thank you guys

Dual A File

Armin,
I have been chatting with you on email...well I called customer service today and they transferred me to an IO - when I asked for my status update she put me on hold after asking for my A number then came back after a few minutes and told me that my case was approved and that an oath letter was mailed out yesterday. I had also set up an appointment for an Infopass for the 15th I will cancell after I receive the interview letter in the mail.
She told me that she could not tell me the date and time of the oath and that I would have to wait for the letter for that information.
I told her that I was very happy and that she had made my day. She was very happy and sounded happy for me too!
I was interviewed on September 11 and I was told at the end of the interview that my A file was missing. The IO who interviewed me was very nice and told me that he knew where the file was and that I would get an answer in 30 days and tomorrow it will be 4 weeks exactly.
My husband who had his interview on the same day and time as me with another IO has not gotten his interview letter.

Hopefully we will both get our letters together so we attend the same oath. I am hoping it is for Oct. 29 as there is an oath that day at Pomona Fair grounds.
Woohoo!!! I am so very happy and I know that GOD IS GREAT!
Armin do not worry you will get your answer soon.......

OK , my case is just getting better and better , i got the letter from them . here what it said :

We have to perform additional review on this case.if you don't receive a decision from us within 9 months please call customer service .???? WTF is going on. I have to take legal action against these people. They are playing with my life.

can any one tell me how can i file a complaint against uscis ?

Thanks

This is crazy? Why you think this is happening to you, What you think they are holding you up for? Was there anything in your past that possibably effecting your naturalization? This is unheard of. Hopefully The letter you have recived is general computer generated form and I hope you get answer before 120 days. I am suggesting wait for 120 days and if there is no answer, hit their butt hard with lawsuit.
