Part 13 and Part 14 are mandatory. You almost certain need a second interview for Part 13 and Part 14. I don't think they can let you sign

72.3 Decision Process. (f) Continuing an Application .(3) Notifying the Applicant of a Continuance .
USCIS has 120 days after the first interview to make a decision about the application.
Except in the cases where the applicant must be re-tested on English language and/or history and government (which must occur between 60 and 90 days after the initial interview), the second interview must take place within 120 days after the initial examination. [See 8 CFR 335.3(b), and 8 CFR 312.5.]

I still say file the 1447(b) anyway. USCIS will probably prefer to just call in armin78 to sign it and decide the case instead of explaining to the court that the files were lost and section 13 wasn't signed. Especially since it is USCIS fault that it wasn't signed.From what I read, ARMIN has not completed the interview since the N400 has not been finalized and signed. It will be hard to challenge on the basis of 120 days of interview rule. Need to think of other kinds of challenges / pushes to get this file moving.
But you have said that IO did not give you anything after interview.What will you submit on your lawsuit as a proof that interview has been done? Is it possible that IO intentionally did not give you anything to hang on to for decision covering his butt for the lawsuit?
The other question croosed my mind is that because you GC was through Asylum did you make any trip to COP and if yes, Isn't it possible that IO saw that in the computer. Just my thought.

I have been chatting with you on email...well I called customer service today and they transferred me to an IO - when I asked for my status update she put me on hold after asking for my A number then came back after a few minutes and told me that my case was approved and that an oath letter was mailed out yesterday. I had also set up an appointment for an Infopass for the 15th I will cancell after I receive the interview letter in the mail.
She told me that she could not tell me the date and time of the oath and that I would have to wait for the letter for that information.
I told her that I was very happy and that she had made my day. She was very happy and sounded happy for me too!
I was interviewed on September 11 and I was told at the end of the interview that my A file was missing. The IO who interviewed me was very nice and told me that he knew where the file was and that I would get an answer in 30 days and tomorrow it will be 4 weeks exactly.
My husband who had his interview on the same day and time as me with another IO has not gotten his interview letter.
Hopefully we will both get our letters together so we attend the same oath. I am hoping it is for Oct. 29 as there is an oath that day at Pomona Fair grounds.

This is crazy? Why you think this is happening to you, What you think they are holding you up for? Was there anything in your past that possibably effecting your naturalization? This is unheard of. Hopefully The letter you have recived is general computer generated form and you I hope you get answer before 120 days. I am suggesting wait for 120 days and if there is no answer, hit their butt hard with lawsuit.
