what was your RFE about?

i think you should upgrade once u recieve RFE, today is bank holiday anyway, i think you should get it with in couple of days so calm, down for couple of days as its not going to make much difference, however as you are replying RFE upgrade to PP.
 
RFE was requesting a copy of my MS diploma (which is already in my file), a copy of my transcripts and a letter showing that I have previous work experience (also already attached). I really don't know why did they request all of these.

it took more than a week to get RFE documents. but it went to lawyer. i am not sure how the post system is working today so i guess you should have it by tomorrow.

If you want to work for two employers you need two H1Bs. So need a new H1B filed for another employer. Unfortunately new H1B would only be issued after April 2007 and eligible to work after October 2007.

You can drop down to part time pay for existing H1B. Your employer needs to pay you the part time pay.

Will it be possible for a person getting two H-1B in the same university (meaning in one department as a full timer and another dept working as a part timer - either working on Saturdays OR sundays OR three days in a week after the full time job). As a part timer how many hours one has to put in. Your feed back is appreciated.
 
For H1 transfer from existing employer to another employer you are not under H1 cap. But transfer means you can work for only one employer and not two.

For a new H1 you get under H1 cap. Availing two H1 means you can work for more than 1 employer.

This is not true. An H1B transfer is basically an new H1B application that is not subject to the quota and that will allow you to work for the new sponsoring company. He old H1B application is still valid with the previous employer and you can work with both at the same time if you wish. You may however 'amend' the original H1B to show the number of (reduced) hours you are working with them if you are doing so part time. I don't think it would be a big deal not to amend your old H1B but its better doing it.

Old application is valid with old employer till old employer cancels your old H1. But if you work for even 1 day at a new employer with whom you have transferred H1 and want to come back, You can not do that with out transferring H1 again.

By doing what you are suggesting I can get H1b transferred to 5 different employer work one day in week at each one of them as I have reduced hours of work from 40 to 8 on each of them.

Hi Gurus,
From the receipt notice for I-140, is there any way to find out if the application is filed for EB2 or EB3?

There is no problem for H1B person to have several employers, the only requirement is that each of these employers must file own separate H1B petition/transfer for him/her, but individual will be counted as only one visa consumer.

If an american can work for several companies, why do you think h1b person should be descriminated ?
 
H1b is tied to an employee. If you transfer it gets transferred. By transferring it does not grant the right to work for multiple employers "simultaneously". This is not a GC or U.S citizen right, it is a work permit granted by one employer.

Changing hours and splitting H1 in to multiple employer is something I never heard and do not believe it is legal without having MULTIPLE H1b visas. Whoever wants to do must get a firm legal opinion and then do as USCIS will keep this somewhere tucked in and ask the relevant question at an incovenient time.

I want to apply new petition from new employer for another part time. Is it legal ? Your advice is really welcome. and keep in mind current H-1 complete six years in Jan 2007. My current employer applying for three years extension based on my approved I-140.

To start with...there is no such thing as "TRANSFER"...it's always a new H1 that is filed. In common language, we call it transfer.
So, what most others have recommended looks good (offcourse, besides Bigbang2001...I can understand you are trying to caution someone...but your tone isn't friendly, dear friend...:)
Go ahead Thota, as per your plan...offcourse, keep close touch with your attorney...very important to get good attorney for smooth transition & future gc issues.

It is not true, do your own research.

USCIS counts H1B people but not employers or H1B jobs. They have concern only how many people entered US with H1 visa but not how many jobs they got. Their other concerns are: Prevailing wage and collecting fees for amend/transfer. When you file transfer/amend you just simply inform them that certain individual will work for one more employer.

I knew guy who got from USCIS 3 H1B transfers the same day for different employers.

With all due respect we are getting side tracked in this thread. I daily visit this thread to see any new approvals, and dont expect a lengthy discussion on H1B.

Can we all please move to H1B forum for discussion related to that.

May 2006 still waiting no PP
