DV 2025 AOS (Adjustment of Status) Process Only

You just need to be patient. It is not unusual for it to take up to 4 to 6 weeks before getting the payment receipt. Stop stressing yourself trying to figure out what the email response means, it’s basically their way of saying you’ll get the receipt when you get it.

To confirm, you did include a SASE with the payment?

This morning, I woke up to my case status showing "New Card Being Produced." for myself and my wife. Truly, this is the doing of the Lord! Hi. F1 student since 2023 but no income that year, so I did not file a tax return. In 2024, I did earn income (on campus) and i will file a tax rerun by April 15 2025. I will have a i134 sponsor who will provide all his supporting docs. On i485, I selected to lowest options for assets and income. I'm 17 years old. I guess I will be current in May.

1. Do I need to submit my 2024 tax return transcript?
2. Do I need to explain why I didn't file tax returns in 2023?

In the new i-485 forms, under Part 3, would you please explain 1.e and 1.f? Relates to 213A of the INA.
1e. You’re not subject to INA 213A (which requires submission of for I-864 or I-864EZ), you do not fall under the exemptions listed in 1a-1d, you’re not required to submit an exemption (meaning you’re not required to submit either of these forms, you’re not seeking exemption from submitting them, and will therefore not be including either of those forms with your AOS package).
1f. You’re subject to INA 213A, you’re required to submit form I-864 or I-864EZ, and you’re not requesting an exemption (meaning you will be submit one or both of these forms with your AOS package).

We’re in the process of getting the necessary vaccinations so the doctor can complete our medical exams. He initially insisted that the exam must be signed within six weeks of filing, even though the current rules allow for a longer validity period. When I pointed this out, he still advised against doing it too early, saying that some officers might not be aware of the updated guidelines.

Have you come across any cases where an application was denied because an officer followed outdated rules? I’d prefer to get the medical exam done now, but I want to be sure it won’t cause any issues later.

I’m yet to come across a case denial based on the IO following outdated policies. However you need to be aware of the fact that an IO has discretion to request a new or updated medical report if they have reason to believe the applicant’s medical condition has changed since the civil surgeon signed the Form I-693.

Also if the I-693 form gets updated after you’ve completed your medical exam and prior to sending in your AOS package, you may not be able to use the earlier completed medical report.

My wife is primary applicant, we are both PhD students and total monthly income is around $3500. We have 2 kids, purchased a house with mortgage around 6 months ago, living with no financial difficulties so far in a small town.

I added our tax returns for the last 3 years, the last 5-6 months' bank statements and pay stubs, and current employment verification letters for each one of us. In this case, 1-e looks more appropriate for us but still there are some people saying that as F-1 students we should still go for 1-f and fill affidavit of support form.

For your valuable experience, what would you suggest me by only looking these information?

All DV based AOS applications fall under the 1e category regardless of whatever the applicant’s financial status is.

In the previous form, there were some yes-no questions followed but "if said yes, if said no" stuff, like J-1 visa question in previous form:

So when people selected no for 24a, they were skipping 24-b and 24-c.

Now in the new form, it does not say skip (19-20-21):

Should I leave them (20 and 21) blank, or select no?

You wouldn’t be penalized or assessed wrong if you tick NO for 20-21 on the basis of having selected NO for 19.
 
I was going through the timeline and I see that up to this date, nobody who attended their interview got a decision yet.
Although this has been a norm for the field office where I took my interview, I could notice that all other offices were doing the same.
Only those with waived interviews received their approval and/ or green card.

Would one be penalized if they insert "N/A" like I plan to do for these questions? Like this:

On the new form i485, Part 4, Q7 says to list educational history for past 5 years and to use Part 14 if you need addition space. The next question, Q8, says to provide the most recent school outside U.S. ("if not already listed above").

I attended a high school in my home country within this 5-year period and it was also the most recent school outside the U.S.

So, should I list this school twice in my application (for Q7/Part 14 and for Q8)? I prefer not to list it twice and only show it for Q8.
