DV 2024 AOS (Adjustment of Status) Process Only

Hello @Sm1smom
What happens in a situation where you haven’t signed and dated page 20 (addictional information)??
Will this definitely be returned? Or is there a chance (and there have been cases previously on this forum OR in your memory) that this is acceptable?

I used one page for additional information (no more copy), used as an addition for two items.

P.s.
I've already sent it to Lockbox. Lockbox accepted my application (get SMS with receipt #).
Now, as I understand it, it is already on NBC and I am waiting for NOA Later.
I am literally in the same situation

i know, i made an error getting a lawyer thinking that the process would be confusing, until i found your forum. Considering my case number of EU84** (uzbekistan) what are my chances if my number becomes current in may? What about june? I know you don’t give predictions but your best subjective opinion would be highly appreciated.

Thx
Like you already know, I don’t make predictions or provide probabilities. I however let you know there have been cases that became current in August or even September (in the past) which successfully completed the process (as long as there was no visa exhaustion). And there have been cases that became current in the early part of the FY but sadly did not get to successfully complete the process.

If you already received SMS from the Lockbox, it means the package has been accepted as is. The worst that can happen after that is either for the IO to ask you to sign the page when you go in for your interview, or for you to receive a RFE asking you to sign and resubmit that page.

Your words really lift my spirits!

@rondon just relax, we're fine. I have a feeling that there are a lot of people in this situation like ours (i-485 is used everyday, not only for DV). I think there is absolutely nothing wrong with this, otherwise Lockbox would actually reject our applications. Let's wait for the decision. Aslo we cannot change the situation. So let's just trust fate then.
Fate will find a way! ;)

Hi Sm1smom,

Thank you for all the valuable information you have in this blog and process, it's helped me throughout my application process tremendously. I am writing this in hopes for any advice you may have for my case. For reference, my username in the AOS Timeline spreadsheet is jr20. I submitted my AOS package mid December, which was received and fees were collected (Dec 22nd). This was the last update to my case in my online account. Based on the previous & current years timelines, I was hoping to get my bio appointment set up in January but nothing has moved so far. I have reached out through the case inquiry "Non-Delivery of Other Notice" in case they mailed my bio appointment and it got lost, but they replied saying it's "pending within normal processing times".
Do you have any recommendations if there's anything else I could do to make sure my case is still moving forward? Do you think calling the USCIS phone number to ask about it would be of any help?
Thank you in advance for your help.

Based on my own experience I would recommend trying to ask Emma again; it’s possible to get a more informative answer.

My husband’s bio appointment letter was delivered to our neighbors by mistake, whilst I had an appointment. I asked Emma twice about his appointment and was given the response you are reporting. On the third time (same day) the agent actually informed us of the date his bio was scheduled for. A.k.a. the helpfulness is agent dependent and it’s certainly worth trying a few more times.

I second the above answer. As mentioned on this forum, I have not received my NOA letter, whereas some people did not receive their bio ( based on the timeline you are not the only one who has not received the bio letter after receiving the NOA). After 4 weeks they replied my service request, saying they had sent the NOA letter but anyway they would submit it again. It looks like there was some confusion with early Jan/late Dec submissions.

Initiate an online chat with Emma. Request to be connected with a life agent, then ask the agent if your bio appointment has been scheduled and what date/time it is scheduled for.

On a side note, do you have USPS informed delivery set?

Hi Mom!
I have a question about USPS Informed Delivery
That is off-topic, but maybe you know about it more.
I created an account, but couldn't figure out its function.
1. Does it only show what will arrives today (and past mail)?
2. Is it possible to view future mail?? [maybe in transit right now, but has not yet arrived at my local USPS]. (in other words: everything that goes to my address.)

Informed Delivery provides digital image of USPS mail and packages scheduled to arrive at your address soon. The operational word being “soon” and not necessarily “today”. I have no idea if the image shows up only after it gets scanned at your local USPS location or not.

Hi mom
I consulted with some friends who have previously applied for EB2. They told me that if the spouse and primary applicant reside separately but the interview is scheduled at the primary applicant's location, I wonder if this situation also applies to DV? I know that the I-485 form requires the current residential address to be filled in. My spouse and I plan to fill out our respective addresses separately for the convenience of fingerprint collection. So, will the final interview be conducted at my place of residence? Do you think this approach is feasible? Or do we have to fill out the same address?

Using the same address is recommended in such a situation as this, couples are presumed to be living together, or at least have the same primary address even if they’re temporarily located separately due to school or work reasons.

The DV based AOS cases that I can recall of in the past in such a similar situation ended up being scheduled for their interview separately, the cases got sent to the specific FO with jurisdiction over the listed address on each I-485, with the exception of one or two cases only that did not get separated for some reason.

I am planning on going with early filing, however, in order to decrease the chances of rejection - do you think it is wise to attached memorandum PM-602-0088 on early filing as part of my case folder, highlighting the portion about 50-60 days early filing?

Moreover, I was going through AOS package: since my spouse is the main applicant, however, she cannot work under her F2 visa, should i leave her evidence of financial support section of her folder with no supporting document, and attach my latest pay slips and W2 on my folder only, or should i duplicate my pay slips and W2 into both her and my folders?

Also, would pay slips and W2 be sufficient, or should i also attach copy of bank statement?

I hope my questions will not put much stress on you, timing is very critical and don't want to make errors, thank you

Thank you for your response. Are you suggesting that it's best for both of our mailing address and current physical address to be the same? However, I am concerned that during the interview, the interviewer may raise questions due to the inconsistency in addresses on our driver's licenses. Additionally, my question is, how should my partner indicate the end date of her current residence? Should it be the same as mine? (Although she still resides there for about three weeks every month). Should I have my partner explain her current awkward situation on the last page of the I-485 form?

I just want to add some additional information to make my following response seem more reasonable. The address where my spouse currently resides is a property we jointly purchased, and we have no plans to sell it. Additionally, I also return to stay there for 2-3 days every one or two months. In this case, can we write "N/A" in the end date field?

1. As already stated in the “AOS Package” tab of the AOS Process Spreadsheet:
*** You may wish to include a copy of the Policy memorandum authorizing early filing especially if filing 2 months in advance***
You can also print out the "Visa Availability" section on USCIS's website that encourages early filing

2. You can include copies of your financial documents in your spouse’s AOS package as the main selectee. Your financial documents are applicable to your spouse.
3. My recommended list of financial support documents are already on the AOS Process Spreadsheet, please refer to it.

Hi, mom

I am so sorry for asking you again. Is it possible to tell me I need to fill in the blank for 'to' for my spouse? I think filling with "N/A" and explain that we own this property and plan to stay here sometime every month maybe make sense, but I need your guidance.

I am not “suggesting” anything. I’m basically saying there’s an expectation for married couples in a genuine relationship to be residing together. And for married couples in genuine relationships who find themselves having to live in different locations due to demands such as work or schooling, they should be able to demonstrate they have a shared primary place of residence. This they have done by listing the primary address as the current address under the physical address section. Then for the spouse who does the commuting, they list that spouse’s address as the next address on that spouse’s AOS form only, with the end date also listed as “Current” also. For the mailing address, they listed the primary address as their mailing address on both forms. This ensures their applications are not separated and send to different FOs. The presumed issue with different addresses on the driver’s is addressed with the presumption that is a temporary address one of the parties is using due to the temporary location based on their work or schooling requirements.

p.s. when you have multiple questions per post, please number them accordingly and make the questions succinct to ensure appropriate responses are provided.

You really need to be patient, I do have a life outside of this forum.

Anyway, take a look at the response I just provided above ^^ to help you determine how to handle your address situation. If you still have follow up questions after going through the post, then go ahead and post them for further guidance.

Listing N/A under the “TO” section of the address is not recommended. You can either put in PRESENT” - to indicate it is on-going (even if that is the second address being listed for your spouse since your spouse is equally still residing there in addition to your jointly shared primary residence), or put an end date if the spouse is no longer residing there.

I apologize for my impatience. I am feeling a bit anxious right now, especially with handling some sensitive information, and I couldn't find a definitive answer online, hence the urgency. I filled out this form with dummy information. All the information above is fake. I just want you to confirm whether the content I filled out aligns with your instructions.
