DV 2024 AOS (Adjustment of Status) Process Only

Hey I m stuck in a situation where I don't have what to do. My case number is 2024AS00XXXX. As per visa bulletin my CN was in January but I missed it and still not done with process, As of now I have already submitted the DS-260. Send the $330 USD fee and received the email confirmation of fee receipt. I have already done my medical and got the document from the doctor. Now I m confused that why I haven't received my 2NL and how does 2NL even look like. I have no idea about 2NL. One of my friend is saying that Fill the I-485 and send all the documents to the local lockbox. with the application fees of $1225. Also I am a F1 Student staying currently in US. DO I need to fill the I-765 or just I-485. Please help me with this situation as I m stuck at the middle of it.Also do I need a sponsor for financial support, or as a F1 I can just continue with out having any affidavit of sponsor?
 
1. The DV AOS based EAD card becomes useless effective Oct. 1st 2024 (assuming your AOS application has not yet been adjudicated by then). So ask your lawyer what is the purpose of the AOS based EAD which he's planning on filing for your spouse.
2. I do not see any question here.

p.s. Your lawyer doesn't seem knowledgeable with DV based AOS applications. Not sure as to why you decided to hire one anyways, considering the wealth of information readily available for free in this forum.

Hello Mom
We are in the process of submitting our DV packets with our lawyer since our case number has become current. My husband is the primary applicant. He is currently on OPT and has an EAD valid till Sept 2024. My doubt is:
1. The lawyer is filing for a fresh I 765 for my husband . Is this required since my husband already has an EAD?

2. We wanted to submit my husbands current salary slips and W2 forms in order to prove that we won’t become public charge (along with i485). But the lawyer says no need to do that since it might cause confusion as we are filing for i765.

I am currently on OPT as well and I didn’t not file for the new EAD card cause I realized it will be useless since the expiring date for the current one is September.
Also I think you can choose to add the slips just for additional information and I know a few people who did. Whoever I personally believe since he is a masters student and has a job that will be enough to satisfy the public charge rule. “That’s my opinion”

1. Stop stressing over the absence of the 2NL, you can file for AOS without it. I suggest you spend some quality time going over the AOS FAQ section of the AOS Process Spreadsheet. You will find the answers to various AOS questions.
2. You may include the I-765 form with your package if you like. Just make sure you fully understand the ramifications of using an AOS based EAD card before AOS approval - this is also covered in the AOS FAQ section of the AOS Process Spreadsheet.
3. Having an I-134 is always recommended especially if you’re not currently employed.

Thank you for your reply, I have one more question, while filling my DS-260 I had a different address and now my address has changed so should I use my same old address while filling I-485 or new address in I-485. Also if I need to change my address before filing I-485 how can I do that.

Use your current address for the AOS filing.
 
1. Not necessary - if you take a look at the "AOS Package" tab of the AOS Process Spreadsheet, you will see the VB is not one of the items recommended for inclusion in the AOS package.
2, 3, 6. Please take a look at the "AOS Package" tab of the AOS Process Spreadsheet for further guidance on recommended evidence of financial support documents.
4. The instruction says: "If you are the beneficiary and are filing Form I-134 on your own behalf, complete and sign Part 4." - meaning if someone else is providing you with the I-134, you as the beneficiary are not required to sign Part 4 of the form.
5. It serves no purpose, include if you like.

I recommend you go through the AOS FAQ tab of the AOS Process Spreadsheet to learn more about Early Filing.

I am filing for AOS with an attorney, however, it turned out that the attorney doesn't have much experience with AOS so I am doing much of research myself.
Today attorney asked me to get some offer letter for my wife saying that some place would hire her upon DV approval - do you think it is necessary.
I am already attaching my pay slips to the application with pretty good annual salary. Since only I am allowed to work, do we need to show any bank records of my wife? Or will recent pay slip with recent IRS tax transcript be sufficient. Please advise.

Your financial documents are applicable to your spouse, even if she is the main selectee. There is no requirement for her to include a conditional offer of employment letter with her AOS package. Of course if she's able to get one, it wouldn't hurt, but I doubt any genuine and reputable employer will be willing to issue such an offer (since there's no way for them to know when he AOS application will get approved).

A little curious side note: so precisely what are you paying this lawyer for if they're not quite knowledgeable and you're doing most of the research yourself?

Thank you very much. They are advising me to file for mandamus lawsuit after submitting my aos application as soon as i get notice of application receipt (NOA i guess this is how it called). Do you think it makes any sense to file lawsuit in order to expedite my case. I hope my number will be current in may or june…

File a mandamus? On what basis??? AFAIK, you have no basis for filing a mandamus. Seems to me you’re about to be turned into a cash cow, and I’m not surprised at that considering the lawyer has no understanding of DV AOS processing to start with, and you honestly could successfully complete the process without the involvement of any lawyer like so many have done in the past. .

i know, i made an error getting a lawyer thinking that the process would be confusing, until i found your forum. Considering my case number of EU84** (uzbekistan) what are my chances if my number becomes current in may? What about june? I know you don’t give predictions but your best subjective opinion would be highly appreciated.

You’re required to sign and date the sheet if you have any information on it.

What happens in a situation where you haven’t signed and dated page 20 (addictional information)??
Will this definitely be returned? Or is there a chance (and there have been cases previously on this forum OR in your memory) that this is acceptable?

I used one page for additional information (no more copy), used as an addition for two items.

P.s.
I've already sent it to Lockbox. Lockbox accepted my application (get SMS with receipt #).
Now, as I understand it, it is already on NBC and I am waiting for NOA Later.
