DV 2024 AOS (Adjustment of Status) Process Only

1. It confirms your case file is with your FO as it should have been - it does not confirm the case hadn't fallen through the cracks while waiting at the FO - cases can fall through the cracks at the FO.
2 & 3. Your call re if you should wait or proceed with the congressional inquiry. DV based cases do not follow the generic AOS processing time which is why we came up with the spreadsheet for monitoring DV based AOS cases in this forum. That is the reason I did not recommend submitting an online case inquiry with USCIS (an option I clearly was aware of).
I noticed your update on the Timeline Spreadsheet with the interview being waived. Congratulations.

I sincerely apologize for asking many repetitive questions. Since I seldom log in to this forum, I didn't notice the previous queries, and I regret any inconvenience caused to you. However, I still feel confused because it seems I haven't received a very clear answer. If my current status is in April, but I mail out the package in March, do I need to pay the new fee (1440 dollar) ? I checked the USCIS official website, and it indicates that the fees are determined based on the postmark date.

Based on the previous discussions, if they receive your application before 1st April, old fees apply. I am in the same boat.

I guess you feel like you haven’t received a very clear answer because I did not provide you with a YES or NO response. I, on the other hand feel like I did a better job of providing you with an applicable response from one of my previous posts which goes way beyond YES or NO. I’m not even sure you clicked on the link I provided to read that response which I referenced. So let me try again.

When your CN becomes current has no bearing on how much you should send with your application. If you’re filing before Apr. 1st, you include the current fee. If you’re filing on or after Apr. 1st, you’ll include the new fee.

If I want to submit in advance, should I print the entire Early Filing Memo document (7 pages) and include it in my AOS package?

For the question 3, I asked the OIA this question before. They replied that once you apply for the EAD and it is approved through the green card process, your F1 status will immediately become invalid.

That’s something you’ll need to use your discretion and decide on your own. Inclusion of the Early Filing Memo does not guarantee the AOS application can not (or will not) be rejected or denied. Non inclusion does not guarantee anything either.

1. If your current OPT based EAD expires in January 2025, a DV AOS based EAD is irrelevant in your case, as the DV AOS based EAD will no longer be valid once your applicable DV based FY ends, which will be on Sept. 30th, 2024. Nonetheless, you may apply for an AOS based EAD card if you wish.
2. The NBC adjudicates the EAD, while the FO adjudicated the AOS. Processing of one has no bearing on the other.
3. Working with OPT based EAD ensures you have a valid status to fall back on if, for any reason, the AOS application gets denied. An AOS based EAD (once used to undertake authorized employment) does not give you any protection in such a situation as you’ll no longer have a fall back status if AOS application gets denied.

BTW, the OIA is Office of International Affairs. I think every university has this office if they have international students. However, at that time, my questions were based on the issues related to my application for the NIW green card.

Regarding what they told you in the above post, that is not correct. F1 (or any other status) does not automatically become invalid on the basis of simply having an approved or getting an AOS based EAD. The status remains valid for as long as the AOS based EAD is not used in obtaining authorized employment. The existing status becomes invalid only IF the AOS based EAD card gets used.

Thank you for the correction. What I actually meant is very close to your interpretation. It may be due to English not being my first language that caused confusion

Hello mom, I have a quick question. The fee receipt was emailed to me. and it's stated "The adjustment of status fee to the Department of State has been paid" and has a pdf of the paid receipt.

I included it in my AOS package but I noticed that it says in the email to complete this payment I need to mail this receipt to the US Department of state P.O box (when it's already paid.)


So, I am honestly confused, is my fee paid or do I need to email this printed PDF receipt back to the US Department of state?

The fee is considered paid. You do not need to send the receipt back to the USDOS.
