DV 2024 AOS (Adjustment of Status) Process Only

Hello! Form I485 was sent today for the whole family. and sent it by mail today. Now we remember that my wife did not sign Form I485. What will happen? will she be returned? will the money invested not be returned? Is there any way to contact the center in Chicago?

If you used separate payment for each of the application in the package, your wife’s application will be rejected by the Lockbox (with the payment) and sent back. If you used a single form of payment for all the applications, the entire package (everyone’s application with the full payment) will be rejected and sent back.

By the sound of it, it appears getting individual cashiers check/personnel check is safe bet versus one cashiers check/personnel?

Yes, that is the e recommendation. Individual payment per application ensures only the application with an issue gets rejected and sent back while the rest continues with the processing (pending the refilling of the one that got rejected), as against having all the applications sent back as rejected.

I am so happy that you are helping us! Hopefully, these will be my last questions before I send my dv lottery AOS for myself this January. Thank you so much again!

1- I just received my dv lottery fee 330 $ receipt notice, I am going to open the envelope and put the receipt that way to my AOS package right? It doesnt have to be closed envelope.

2- For printing the supporting documents such as passport etc does it have to be colored printed or does black and white print fine?

3- I am a student, with asylum pending status, and have no salary on my own, so my husband is filing a I 134 financial support. he is a citizen. For Form I-134 should we include all or only one of these for him? birth certificate, passport card or passport book?

4- I have no salary on my own I am a student, my husband makes around 83000 annually, Do you think we should include these bank accounts or is his annual salary would be enough for the I 134, and if you think we should include it, for the joint account, will I include that under both beneficiary and financial supporter?
- I have a personal checking account of 5000$.
- My husband and I have a joint Ally money market account with 10 thousand$, which I would think would go under savings.
-And my husband personally has 25 thousand$ in a vanguard brokers-investment account.

5- In I-134, there is a question for the beneficiary (me) asking the anticipated period of stay, for end date I clicked no end date, but for start date I have to write a date, and I wrote the day I entered the US in 2021, even though it’s a past date do you think its fine or should I do something else?

6- Just to make sure, I live in NJ, so I checked this website USCIS Lockbox Filing Locations Chart For Certain Non-Family-Based Forms

And so I will be sending my aos package to either of these, is that correct?

1. Add a copy of the payment receipt to the AOS package. Keep the original for when you get called in for your interview.
2. Colored, black & white? It doesn’t matter. What matters is for the documents to be clear and legible.
3. One copy of a government issued form of ID.
4. Take a look at the AOS Process Spreadsheet for what should be included in support of the I-134.
5. Start date should be the first day and month in which your CN is current.
6. See this post to confirm your applicable Lockbox.

And one last thing, in the form I134, for the financially supporter, this table I am writing my husband's info as the financial supporter, would I add myself as a dependent since we are married? I got confused because of the paranthesis (do not include any individuals named in Part 2.) If so, would I add him as a dependent in the beneficary table? Or do I just fill the beneficiary and financially supporter 1 and 1.

Only your husband gets listed. Relationship will be listed as spouse, and not self.

Ignore my previous response which isn’t quite accurate ( I did not take a look at the actual form before responding).

In order to fill out the form, think of it this way:
Part 2: Information about you as the beneficiary.

Part 3: Information about your sponsor

If you’re still confused, take a look at the official instructions provided by USCIS for filling out the form.
 
Awesome! thank you so much, I think I am just going to not include spouses and do my husband as 'self' with 0 dependents, and me as 'beneficiary' with 0 dependants since it says do not include individuals listed in part 2 and part 3. Thank you so much!!!
 
Form I-485, for Part 2, Q3 and 4. has the following question:

1) I am not sure what receipt number its referring to?
2) What is the priority date for the underlying petition?

We have a I-130 petition made by my sibling..

Sample I-485 has N/A to everything from Q3 to 9.

Your pending I-130 has no bearing on a DV based AOS application. There’s no underlying petition for a DV based AOS application, those questions are not applicable to DV based AOS application, which is what the sample I-485 is demonstrating. Not every question on the I-485 is applicable to DV based AOS filing.

• Enrollment verification document from school (If applicable)

Can we use electronic transcript, or unofficial transcript or does it have to closed envelope signed and sealed by the university?
