DV 2024 AOS (Adjustment of Status) Process Only

Hi Mom,
2 years of military service is mandatory for all men above 18 years old in my country of citizenship, but due to the law I was exempted to do that and I've never done any kind of military service.
Now the question is this, was I needed to file the related documents that show I'm exempted from doing military service in my country in my package? Do you have any experience close to my situation?

Some in similar situation included the exemption documents in their AOS package. Some did not and had no issue with not doing so.
 
Hello everyone.
After several unsuccessful walk-in attempts to Santa Ana field office to clarify my situation and unsuccessful attempts to have a call back from Tier 2 customer support, I’m trying to prepare for the interview on coming Monday. Per USCIS officer on the phone (see my quoted post), my case is not applicable due to early filling.

1) what should I expect on the interview?

2) after more detailed review of USCIS manual, I’m a little concerned that the officer may simply refer to the Chapter 4 - Adjudication of the same manual where:
and I don’t know how to react on that.
Like @Xarthisius previously answered, attend your interview with a print out of the August VB which was released on July 3rd. The Advance Notification chart (Section C) of the VB made you eligible to file when you did. Politely point out the release date of the VB was before you filed for AOS and based on the USCIS Manual, you were eligible to do so.

I have contacted with congressman assistant and he talked to Dallas field officer and he told him I need to submit other documents. So, I have done that last Monday. Also, his contact told that is under the reviewing and should make decision soon. Do you think I should walk in to dallas field office and try to talk with the supervisor??? Or just wait for any update??.

At this point, I think you should proactively do what you deem best for your case rather than waiting for someone to recommend what your next step should be out of the two options you laid out.

If I want to add these documents to my package, Do I have any chance to take those documents in person? Or is there any place that I can add them online? Or mailing them as a worst way
I also need to mention that I submitted these documents when I applied for my visa (will officer access to them? If yes so I will not need to send them again)

Take them along to your interview, if one gets scheduled, and present only if asked.
 
@thisistanya, may I know how fast you received a response from the White House after you submitted the form? I just submitted it this morning and wondered when I should expect the response.
Hi! Sorry for the late reply. It took 7 days for the White House to respond to my inquiry. I was not able to attach evidence to the submission form online. So, I mailed it to them to the White House address and marked on the envelope that it is urgent.

I have a question about my status after my case denial.
I am on F1 status and my visa is expired (just have the I-20 until 2024). Since my i-485 probably will be denied, can I apply for OPT or CPT in the future? I will be graduated soon and I need to apply for OPT.

The visa stamp is basically the document for seeking admission into the US, so no problem with the F1 visa being expired as long as you have no current plan of leaving US and seeking re-admission after.

I don’t see a problem with your OPT being denied as long as you’ve been maintaining your F1 status.

I am asking because the an officer in international office of my university told me: filing i-485 means that I have immigration intension, which is in direct conflict with the F-1 status.

Why did you inform your school you were filing for AOS in the first place? This is precisely why we recommend not informing your school or employer in advance when filing a DV based AOS application since approval is not guaranteed. At this point you need to confirm you’ve not been terminated from SEVIS.

To clarify, I have not informed the school about this issue at all. I only asked a random officer in the international office because a friend of mine, who applied for NIW and filed an I-485, mentioned that their lawyer advised them they cannot apply for OPT while their I-485 is pending.

Again, check to confirm your status has not been terminated in SEVIS. As long as your status has not been terminated, there’s no action I’m aware of that you need to take.

Thank you. The IO kindly listened my arguments and held my highlighted printouts for further review to make a final decision regarding early filing. My case still have background check pending, so I only need to hope for the best during next couple days.

I really hope you will be okay. This makes me think that the pending background check is a problem across all the pending cases that haven’t received an interview notice :(
 
Regarding SSN update, I answered "yes" to "Do you have a SSN", what should be my next steps to get an updated SSN?
 
Our case is still waiting, and there are no updates. Even after the USCIS chief emailed us 30 days ago saying, "Your applications are in the "decisional" phase of review," we couldn't get an update from the field office.

I saw @sideyn get approved without an interview on 8/26, and @alinat6 received an interview notice on 8/28. Congrats to both of them. Hopefully, we will be next!

I'm trying to reach USCIS again. Let's see what will happen. It is four months since I delivered my second RFE response to USCIS Chicago FO.
Any update so far? Still rooting for you guys.
