DV 2024 AOS (Adjustment of Status) Process Only

Hi Mom,
I did my biometrics July 1st and didn’t hear anything yet my current status is Finger print were taken. Is there anything ai can do can I email them or expedite the process for the interview. I live in Boston
I am so worried as the current visa bulletin is so high and so worried that the visas will run out.

Based on the updates from other DV based AOS cases from your FO (which I presume is the Boston FO) reported on the Timeline spreadsheet, your case is on track. So you just need to exercise some patience.

In the interim, I recommend you also add your case progress to the Timeline spreadsheet.
 
My passport would expire in 3rd Feb 2025 while my interview would be late August or September 2024 tentatively. Would there be any problem, incase yes can I still send by AOS package and in parallel apply for a new support.
 
Hi everyone,

I have a question on behalf of another person related to the name in the DV application form:
  • During the DV registration, he input his first name with his father's name (not a middle name, but a common name in Russia). For example, First Name: "Ivan Ivanovich". He did this based on guidance, and all his previous visas and I-94 forms were with "Ivan Ivanovich."
  • His foreign passport does not include the father's name and just has his first name: "Ivan." His current visa also has just the first name.
The questions:
  1. Is it correct that for the I-485, he should input just his first name without the father's name, based on the passport?
  2. Will it cause any issues for the adjudicator to have different names on the I-485 and his KCC winning letter?
  3. Should he attach any explanation to his package due to this matter?

I reached out to congressman to seek help with my denied case. This is what they said "Unfortunately, once a denial has been issued there is nothing our office or our liaisons can do. The only way to have it reopened is by the I-290B. Once filed, our office can request an expedite on that."

I know I-290B is a waste of time and money and I have already filed a new application, waiting for the receipt. I wanted to ask if there would be any negative consequences of filing a I-290B in the mean time for my denied case. Just want to make sure I'm doing everything I can do on my part to pursue this opportunity.

My sincere apologies if I did. I didn't mean to waste your or anyone's time with this question. I'm just worried about my application and I wanted to defer to your experience to see if it has been done before (I mean both new application and motion to reconsider at the same time). I'm just not clear whether having done so would cause any issues with the new application.

So sorry to hear about your denial. I may have missed an important information about why the denial? I think applying again might be something you want to decide personally. I have not heard it before that someone has reapplied after a denial. Praying that everything goes well for you again.

I am EU45K with a J1 visa. I was desperate for the DV but seeing that September update gave me hope. Should I start the process and submit the DS260? I am traveling in Europe in August and don't want to show any intent of immigration and be stuck at CBP on the way back. Could you please advise me?
Also, I just started EB2 NIW with a PD in May 2024, i140 is still under review, but the DV would save me a long wait.

I am EU45K with a J1 visa. I was desperate for the DV but seeing that September update gave me hope. Should I start the process and submit the DS260? I am traveling in Europe in August and don't want to show any intent of immigration and be stuck at CBP on the way back. Could you please advise me?
Also, I just started EB2 NIW with a PD in May 2024, i140 is still under review, but the DV would save me a long wait.

Hi! I am not a specialist in the process, just going through it. But I would recommend reading all the information in the spreadsheet. 1. You are not required to submit DS260 for AOS 2. If you have submitted I485 and left the US without an approved travel doc - USCIS will reject your application.

Passport expiration in Feb. 2025 is not an issue.

He can list his name as "Ivan Ivanovich" on the I-485. No need for an explanation IMO.

OP does not need to make a personal decision of re-applying following an initial denial. OP was already informed he can re-apply. And yes, this has happened before. More than once, as a matter of fact.

Have you actually gone through the AOS Process Spreadsheet? I recommend you spend some quality time going over that tool to ensure you have a good understanding of the steps involved with filing a DV based AOS application. You talk about traveling to Europe in August and not wanting to get stuck at CBP on the way back - so when do you plan of filing for AOS in that case? I think you should give your travel plans another thought.
 


Hello so I came across this data. I cannot specifically verify if it is indeed accurate but it shows the number of visas issued so far under the fiscal year and what is remaining or pending. It’s from the Ceac website. @Sm1smom @SusieQQQ do you think this is a helpful data or you have much knowledge about it. I just thought of sharing so everyone can also see. Kindly let me know if it’s irrelevant and i will take it down.
 
I have an additional question related to my case. I have an interview scheduled next week, and as other applicants have mentioned, some attorneys recommend not disclosing traffic tickets on the I-485 form. I faced a similar situation and answered "No" to questions 25 and 27 in Part 8, even though I had two traffic citations in 2016 and 2023. I plan to disclose these at the interview, but I want to understand the best way to do so:

1) Should I notify the Immigration Officer (IO) before the oath that I would like to disclose the traffic citations, or should I wait until they ask questions 25 and 27 explicitly so I can answer "Yes" and provide a verbal explanation?
2) Should I update my I-485 form in advance to reflect this information by changing my answers and providing an explanation in Part 14?
3) If the answer to (2) is yes, my I-485 edition is 02/21/23 (outdated). Should I use the same version?
4) My Part 14 is fully filled. Is it acceptable to add an additional page to Part 14 to provide the explanation?

@Sm1smom please see the following message, have you came across this response from USCIS: USCIS records indicate that case is pending at the Field Office. USCIS is committed to adjudicating immigration benefits in a timely and efficient manner while also ensuring public safety, national security, and compliance with all relevant directives. . Please know that this application is in queue and has not been overlooked.

So this is only CP data I presume and I want to believe AOS processing or data are not that much compared to CP data. As in more DV candidates are using the consular processing than AOS right?
