DV 2024 AOS (Adjustment of Status) Process Only

Unfortunately, I cannot guide you on how to maintain a valid status to ensure you’re eligible to file AOS when your CN becomes current, that is outside the realm of the guidance I provide here. I recommend you consult with an experienced immigration lawyer to enable you figure things out.

Once that is done, I will be more than happy to walk you through the DV based AOS processing.

Can I submit my AOS along with an I-765 before my case number becomes current? Would it be considered a pending I-485 that can lead to an approved EAD?

You will not be eligible to file for AOS if your CN is not below the cutoff number listed on the VB.

No it will not. USCIS will not hold on to your case pending when your CN becomes current on the VB. The VB determines when you become eligible to file for AOS. It really is as simple as that. Yes, I know of cases filed while the CN was above the VB cutoff numbers - those cases were rejected or subsequently denied. What you’re proposing is known as frivolous filing.

Stop listening to people who have no knowledge of DV based AOS application process. The best thing you can do for yourself at this point is to turn yourself into an “A” student of the process - you can do this starting with diligently going over the AOS Process Spreadsheet.

Hi everyone, my case number is EU40XXX. I am still debating whether or not it's best to file DS-260, considering that my case number is on the higher end of this year's DV lottery. I am currently in F-1 status and plan to remain in the States during the AOS process. I am just looking for advice/a second opinion on my case. I know that DS-260 isn't required for AOS, but were there cases of denial because a DV winner had not filled out DS-260? Also, will it hinder my chances of obtaining a GC if I wait until a few visa bulletins come out and file DS-260 in November/December?

1. If cases get denied due to failure to submit the DS260 form, we wouldn’t have stated it’s submission is optional.
2. No issue, provided you’re processing AOS.
 
Hello, I will be doing AOS for DV2024. I am concerned about my lease contract ending before I receive an interview invitation, green card, or any related mail. Do you know if it is possible to have everything related to DV receive to a USPS PO BOX instead? Is it a normal practice? Thank you!

Yes, you can use a P.O. Box as your mailing address.
 
Hello, I can't locate my high school diploma. Do I need to submit my high school diploma to USCIS if I have a Graduate Degree?
