DV 2023 AOS (Adjustment of Status) Only

Hello Mom! I am concerned about a couple of things that non-approval of my visa can cause to my future. You said that immigration intent should not affect my OPT application. What about an H1B visa? If I want to stay in the US through work, will my immigrant intent interfere with my ability to get H1B visa?
 
Sorry for the subsequent messages. But I also talked to USCIS yesterday, they told me that something about an audit on my case on March 29, 2023. Does it mean anything?

These days I am filling up the forms and collecting the necessary documents for AOS package. I have a couple of questions regarding forms I-131 and I-765:

1. I-131 (AP): If something unfortunate happens back home, I might have to go to my home county and be back in the US. So this sounds like a useful form to me so I am thinking to submit this form. Now my question is: If I have an AP card, but never have to use it (never had to travel, so); in this situation does this invalidate my F1 status if my AOS is denied?

2. I-765 (EAD): Since my wife and I are both graduate students, we have no interest in working outside of the campus, does this EAD card help in any other way? I do not see any good points in filling up this form for a student like me. Am I missing something?

No impact. H1B is a dual intent visa.

1. Your F1 status remains intact if you never use the AP card.
2. You don’t need an AOS based EAD in that case.

In the AOS package assembly, I saw many people NOT applying for AP card with DV-based AOS. Is it because AP card processing time is longer? I think that my CN will be current either in June or July. So I will have less than 3 months to go through the entire process to get GC. In this situation, is it a good idea to apply for AP card? Are there any downsides of the AP card?

I don’t know, I can’t speak to why most have not included an I-131 for the AP card with their AOS package. It could be because the processing time for AP is usually longer compared to processing time for a DV based AOS application (since DV based AOS applications go through an expedited process), or they have no plan of traveling while their AOS application is pending, or they’re on a dual intent visa which allows they to travel without needing an AP card while their AOS application is pending, or they’re not aware they could file for it. You’ll need to decide on your own if applying for the card is a good idea for you or not. All pertinent information regarding the AP card have been provided on the AOS Process Spreadsheet and my previous response to you (including this one by the way).

Scrolled down to “Most Common Reasons for Filing Form I-485”

On point seven there it mentions -

A diversity lottery winner eligible to file Form I-485
And right below it says -

Go to our “USCIS lockbox filing location charts for certain family based” form page for the filing address based on where you live”


Clicked above link and it takes back to the option 1 again

“Direct filing addresses for form i-485, application to register permanent residence or adjust status”


The whole process repeats again but no where it mentions where to forward the AOS package.

However after intensive research i found mine is Chicago lock box.

There was no need for any intensive search. The information you needed was right there. All you needed to do was open the link, read the first sentence, then scroll down and find the Lockbox address applicable to your location from the table in the link I sent considering I specifically wrote “Your applicable Lockbox can be found on the table in the below USCIS Lockbox location link” It helps to pay attention. DV falls under the family based lockbox filing category.
 
I am current in May and trying to complete my I-485. Am currently on Asylum Pending. i am the applicant and spouse and kid are in my home country as derivatives. i have some query

question 7. I did a traditional marriage. what are the pro and cons?
Question 10. Is your current spouse applying with you?

2.question 53. I have worked in Psychiatric Hospital where patients come for evaluation which range from 7days to years. should i fill in yes or NO.

3.question 62. size of my household. should i answer 1 or 3.

Yes you can apply. I have no idea as to how soon it will get approved. Since the trip is being planned for the summer, I don’t see the AP being qualified to benefit for an expedite request. If approved, yes that that is the only option for returning to the US while your AOS application is pending. If the AOS application gets denied for some reason while you’re out of the US, the AP card automatically becomes invalid and cannot be used to return to the US.

Hi Mom,

I am assembling my I-485 package and planned to use small sticky tabs in the bottom part. However, I saw 11/16/2022 USCIS’ announcement recommending not using this kind of stuff:

However according to “tips for filing for mails”, it’s OK to use them if the delivery location is a lockbox.

The problem is, most of the supporting documents are a few pages like passport pages, marriage certificate. I am confused about this recommendations. Should we use sticky tabs or not?

Considering you already have a pending asylum case, what was your original plan for meeting the marriage certificate requirements when you eventually file for your spouse (after your asylum application has been approved)?

Anyway go through the USCIS Manual and review the section dealing with Unavailability of Records and the Use of Affidavits for instructions on what USCIS may consider in place of a non availability of an applicable document:
