DV 2023 AOS (Adjustment of Status) Only

Thanks for the response, Mom! The point is that the congressperson did not tell me that my case is under Administrative Processing. He just gave me the deadline and more than 3 weeks have passed. I have called USCIS and checked online, there are not any updates on the case. You are right that I need to exercise patience, but at the same time, I want to make sure that I do everything in a timely manner and do not miss the October 1st deadline.
The congress person provided you with the information they were provided with. The FO most times will not outrightly state the delay is due to to AP, they often say case is under review. However experience has shown that typically is AP.

I got it, Mom. I hope you understand my concern. In your previous experiences did people get their AP cleared before the deadline or they always get stuck there?

Of course I understand your concern considering I’ve been doing this for over 10 years now. I know what is at stake, which is why I do what I do here for free. You can go ahead and initiate an ombudsman inquiry now if it makes you feel better, I don’t want to come across as discouraging. Most folks usually get the AP cleared eventually before or by the end of the FY, a few unfortunately do not.

All you do for us is appreciated. It would be almost impossible for us to do all these without this forum and your replies to our questions.

Considering that I fail to be cleared for a background check. Will the fact that I have had immigration intent before and have filed I-485 create problems for me to get OPT or a non-immigrant visa in the future?

It shouldn't be a problem with getting your OPT approval. The declared immigrant intent however could lead to a NIV denial by the embassy unless you're able to convince them you no longer harbor an immigrant intent.

Hello, is there anything i should do?

1.i am waiting on my number to become current or the website to state current so i can send in my AOS package.
2.i am writing to kcc regarding why my ive recived receipts for 3 out of five on my family members.
3.im waiting till the end of the month to take the medical exam.

any advice?

2 + 3 is 5, or is it not? You previously confirmed having the two receipts for the 5 people in your family, so why are still you going on and on about KCC sending you a receipt for just 3 people? If you can’t keep track of something as simple as this, maybe you should consider hiring an experienced DV based AOS immigration attorney to help you through this process.
2. regarding the $330 fee, i have a family of 6 and i sent in the full amount $330 for each however, i got a receipt for only "two persons", im not sure where the rest of my money went. i sent kcc an email however their response wasn’t relevant or helpful. What should i do?

Regarding number 2, i found another email, with an updated amount of 990 for 3 people. now in total i paid 1650 for 5 people. i had to go back at look at emails to refresh my memory, sorry! i remember just sending the money orders with the case number and thats it. im not sure what to do next.

Im sorry if my posts has frustrated you. I missed the simple facts that the receipts are sent separate equaling 5 that i need. I've been on a pending asylum for a decade so i'm very uptight and don’t want to miss this opportunity; this is a touchy subject for me and while trying to prefect it, i get tunnel vision. I appreciate the support here that i haven't found else where.

hi, @Nicdep as we are at the same FO NY, how does your case look like? still waiting? any movement on their side?
Hi Sebastian, same of a month ago...no new updates, and I gave up contacting live chat, their replies are useless. Please let me know if you have any updates on your side.
thank you for reaching out.

Hi @Sm1smom, I sent my AOS beginning of Nov. I am FO queens and no movement happened after my bio. I also did inquire my congresswoman (this was more than a month ago) but nobody reached back. What would be your advice in this case? contact the congresswoman again? (I had to send a FAX at the time of the inquire).

Thanks
N.

One month is too long to be waiting for a response from your congresswoman's office after reaching out to them for assistance. Yes, contact them again (is FAX the only method for requesting case follow up assistance from them?), and if they haven't reached out to acknowledge your request within two weeks, I would say try your senator's office in that case.

Thank you very much for the advice!!

I will submit another request. Since there is as option "deliver in person" I will do in this way this time, then I ll wait two weeks and if no response from the congresswoman, I will contact the senator's office as you advised.

Thanks again,

Hi mom,
1.I sent two money others for my dependents and I on 3th March, still no mail received from KCC. I check my tracking number, It is said label is created but not sent back to me. How long it will takes time to receive any mail from KCC?
2. My case number is AS8xxx. still waiting to become current, considering the new update for medical report about USCIS Removes 60-Day Rule for Civil Surgeon Signatures on Form I-693, do you advise me to provide medical reports now?

Thank you

1. Please take a look at the Timeline spreadsheet to get an idea of how long on average it’s taken other people to get their receipts.

2. Sorry, can’t advise you on that. You’ll need to decide on your own.
