DV 2023 AOS (Adjustment of Status) Only

Hi @Sm1smom , I just received the I-797C Notice that my AOS application and fee was received. The address indicates that it was sent from the National Benefits Center in Lee's Summit, Missouri (which is right next to Kansas City). Does that mean that the biometrics and/or interview might be assigned there aswell?

I'm asking because I'm in St. Louis, and using the FO and ASC locator on the USCIS website (for my current address), both are supposed to be located in St. Louis.

I just called to the chase bank and they told me that they haven’t cashed my money yet. Very busy I think :( I’m gonna send my paperwork without the receipt and 2NL form next week. I just want to say that if you are in process of getting your green card, fill out your ds-260 as soon as possible as well as send money to the department of state asap.
When did you send the payment?

It’s been a while since I have given the finger prints.

When I do e-requests, last week the referral ID ended with ASC identifier, today I received referral ID back from the NBC.
Agent said the case is under review.
Does it mean that the case has forwarded back to NBC please.

Thank you Sm1smom Last case status was , Interview was rescheduled, I had checked with the call center and they’ve said I hadn’t missed any appointments. But advised me to make an e-request. Then received the reply from the ASC later for the e-request through email.
Just trying to figure out if the case is still at ASC under review or moved forward for the time being please.

Like I earlier responded to someone else not too long ago, the AOS application does not get sent to the ASC. The case file goes from the Lockbox to the NBC to the FO. Please take a look at the Lockbox_NBC_FO tab of the AOS process spreadsheet for more on this. Your file should already be at your FO. I believe the status update you’re seeing is a case of someone selecting the wrong option with the update. I agree with the agent’s response about your not having missed an interview appointment. If you miss your interview appointment, USCIS wouldn’t have automatically rescheduled it, the automatic reschedule only happens if they were the ones who canceled the original appointment.

Meanwhile, I recommend you add your timeline to the Timeline spreadsheet to provide better insight into your case progression.

Yesterday we had biometric ( walk-in one week earlier than scheduled / Long Island City, NY ). Everything went super smoothly. Today for my wife and myself status has been changed to: "Case was updated to show fingerprints were taken : fingerprints relating to your AOS have been applied to your case," but there is no change on my daughter's case number - still only "case was received" (she is 4 so only one fingerprint has been taken + photo and signature (parent)

Quick question: it's nothing to be worried about?

First off, I’m trying to find the tab for edit request on the spreadsheet, and I see someone probably made changes to the presentation which was as per CN current month before, now all mixed up.

Can I be optimistic on the rescheduling interview was done by them as towards interview waive off please.

Hello Mom! I am planning to take action if my congressman cannot do anything about my case(which seems like he cannot). Considering my timeline, what would be the best timing for contacting the Ombudsman and possibly filing a writ of mandamus? I would appreciate any time frame that you could recommend me.

For access request:
1. Click the Green View Only dropdown at the top of the spreadsheet
2. Follow the instructions beneath it

The spreadsheet has been restored. I cannot speculate as to the rescheduled interview message being an indication of an interview waiver.
 
Hi Hamo, Yes, I was looking at the same pace of our applications so far. As @Sm1smom says it is very unlikely this is not happening just by chance.
@Sm1smom am I understanding correctly that NY FO "accumulates" DV before starting interviews? Is there a risk they will be very late and the fiscal year will end before they process all of them (especially for who filed at the beginning of the fiscal year (in my case in November).

You can go ahead and initiate the ombudsman inquiry now if you like. Do help me understand, precisely what sort of action are you expecting from your congressman which he seems unable to make?

Thanks for your reply, Mom! The only thing I wish at this point is some kind of movement in my case, at least some kind of action or any information on why my case is delayed. But I have not gotten anything related.
 
Is there any successful Ombudsman appeals that I can refer to? I do not know exactly know what I should include in my request to them. It would be great to look at an example and see what I should be pointing at in order for my request to be accepted.

Has the 30 day deadline elapsed? I already explained neither the congress person or a senator (and not even the ombudsman) can compel USCIS to approve any case pending background check clearance. I already recommended following up with the congressman's office if there's no update after the 30 days has elapsed. Just because you see no update online does not mean there are no actions happening behind the scene. You basically need to exercise more patience.

I suppose if you want to force a decision one way or the other, which may not be to your advantage by the way, you can file a WRIT of mandamus (not something I've ever recommended for any DV based AOS applicant to file).

You can always email the proof of payment back to KCC.

Thanks for the response, Mom! The point is that the congressperson did not tell me that my case is under Administrative Processing. He just gave me the deadline and more than 3 weeks have passed. I have called USCIS and checked online, there are not any updates on the case. You are right that I need to exercise patience, but at the same time, I want to make sure that I do everything in a timely manner and do not miss the October 1st deadline.
